Supreme Court Judgement Granting Financial Autonomy To LGs In Nigeria

Awesome News!!!!
Nigeria's Supreme Court has ruled that local governments can receive money directly from the Federal government. The court declared that it is unconstitutional for state governors to withhold and utilize allocations meant for Local Government Areas without transferring the funds to them.
The 774 local government areas (LGAs) will be given full financial autonomy across Nigeria...
Do you understand the Judgement and its implications?Did you know that local government chairmen do not have Immunity in Nigeria...?

  1. This is a step in the right direction, now we can hold the local government chairman responsible for local governance.

  3. This is a step in the right direction. However if I'm to play the Devil's advocate, I fear it may also have some dire consequences.

Firstly, local government chairmen, will no longer be accountable to their State Governors. Who then will monitor their activities? A local government chairman who is allocated 100million monthly, may simply divert the money to his personal funds, knowing that he is not accountable to the State level. A duly elected Chairman can only be removed by the Local Government House of Assembly and not the Governor.

Secondly, the yardstick for allocating the funds will have to be clearly spelt out. An oil producing LGA for instance , will not want to receive the same allocation as a non revenue LGA.
The FG should have to clearly spell out the criteria, else there might be a constitutional crisis.

Lastly, the State Governors may want to renege on their duties by shifting everything to the Local Governments. Road constructions, payment of salaries, community development projects may be left solely to the LG Chairmen, who may eventually be over burdened.

Apart from these, it's a welcome development , and a step further to true Federalism.
