Singer Davidos baby mama Sophia Momodu has filed a comprehensive 102-paragraph counter affidavit to oppose Davido’s request for joint custody of their daughter Imade. This follows Davido’s recent suit, alleging that she has denied him access to Imade and extorting money from him.

Sophia will win full custody if she wants it on two grounds. One, Davido is always traveling and is a known drug user and secondly, she can claim that what happened to Ifeanyi was partly due to his negligence she wouldn’t want that to happen to Imade. The only reason David wants joint custody is because he wants to stop Sophia from continuing to milk him while now allowing him see Imade when he wants. Sophia has people backing her cos how is she affording a SAN? I just wish they would take this issue out of court and settle but apparently, it has passed that phase.

DeleteAnon 1602 is the only sensible response here. Custody issues are about what can be proven and although using a dead child may be distasteful it is the truth. Davido's loud and lavish lifestyle of clubbing is not doing him any favours. His video on his knees begging for toto was seen by everyone. His smart move was marrying Chioma. That way he can at least prove he has a stable home.

I was thinking it's joint custody they had before but it seems all he ever had was unrestricted visitation rights (at least when the going was good) while the child lived with the mother full time. To be fair, it is best for a judge to decide on this case given the evidence he is presented with.

Should Imade be in the care of a nanny versus her mother. The mother may not have the level of financial means that the father does but she has the stability. Further, she is the same gender as the child. Most courts will not give a father full custody for an opposite gender child, unless he can prove in great detail that he is a better parent than the mother. Davido has twins at home and still wants this woman to live without her child, for what? A child that is being well taken care of and who is well adjusted in every way.

I believe he is asking for joint custody, which means that the joint custody he obviously enjoyed before, is no longer available. In court, the basis for establishing fatherhood is biological or via adoption, not based on marital status.

You guys are kidding . The child support that may be enforced by the court is going to be way less than davido is already doing. Remember this is Nigeria not the states. Ask Adenuga baby mama how much she gets ?If she goes to the states to file, the child would be taken away from her and given to David’s who has better income and more stable life right now. I know you will quote David’s sins but Sophia also has previous drug use evidence that have affected imade adversely when she was a baby and it was documented and she posts semi nude photos which doesn’t make her a role model either. Given that both of them can be deemed unfit parent, David would win cos he would provide a more stable life to image than Sophia who has no stable job and no stable family at the moment.

I've personally handled matters where a mother was denied custody of her children, because the court felt she couldn't adequately take care of them.
Custody may be either temporary, sole, spilt joint or 3rd party. Joint custody arises when both parents are directed to share responsibility of the child.
What this means is that the parents are involved in the physical sharing of visitation rights over the child and in decisions affecting the child's life such as education, medicals, and general welfare. This is what Davido is asking for.
For Sophia to counter his prayers, she would have to prove that Davido had earlier abandoned his daughter, that she has the financial means to take care of all decisions concerning the child and that Davido will be a bad influence to the child.
