Student In Viral Bullying Video Sues School N500 Million For Damages

Namitira Bwala, a student of Lead British International School Abuja, who was in a viral video where she was slapped over 11 times by fellow student Maryam Hassan has filed a lawsuit against her school. She says that the school failed to provide her with a safe and conducive learning environment.


The lawsuit was filed at the High Court of the Federal Capital Territory , Abuja through her lawyer, Marvin Omorogbe. Among her demands are a public apology to be published in two national newspapers and compensation totalling ₦500 million for general damages.

Ok i get it that she cannot sue the person who bullied her cos she is underaged, so she is suing the school via her parents...Lawyers if i am right, can her father not sue the father of the girl that bullied her?

  1. Good. All these big schools without good Again safety measures in place. That kind of school should have CCTV with someone maning it 24hrs. If such measures is put in place students will know they're being monitored and will always behave well. I can't stand bullies honestly. In addition the parents of the bullies should be jailed for falling to bring up their child properly thereby constituting nuisance to the society .

      Civil cases are more difficult to prove than criminal ones. It is not a "Nigerian" thing.

    2. There's a viral video so there's definitely proof. @ Dog, the case might not drag because these are influential people. Stella, the girl is underage so she can't be sued, her parents didn't enable the act in any way, the bully's father was even begging the victim's aunty.

      However, the victim said a teacher saw them and didn't do anything, a similar video of a boy being bullying the same school also surfaced online. Clearly, bullying is normal in that school and teachers turn a blind eye, this case will make the school to sit up by force.

    3. Civil cases are more easier to prove compared to criminal cases. That's the law.

      Delay in civil litigation in Nigeria is primarily caused by the Nigerian factor.

      She can sue the girl who "allegedly" slapped her. The non-joinder of the girl to the suit (if it is so) may be a tactical move, a blunder, etc.

It is not necessary lawyers because of their own selfishness will always advice this but what of her future ?she can continue in that school and the right person to sue is the persons that slapped her but adding the school was because it happened on their premises and she has a good case but what of her future?let peace reigns

    1. Yes, it can. If it can be proven that the school created a toxic culture without addressing issues, that lead to the incident then she had a very strong case. What her lawyers will want to do is to hear from other students current and past who can corroborate to solidify her case. Better if this move from a single complainant to a class action suit.

      The school name being dragged through the press and the destruction of their image will be extremely important to them. Most hoity toity institutions do not want their names associated with any negativity, it is bad for business and school is a business.

  13. Stella, I find the case quite confusing. Legally speaking, this is an action in personam, meaning that the wrong was committed by a specific individual. Therefore her parents would not be able to sue the other girl's parents.

    In my opinion, the case will be a difficult one. If it were to be a teacher who did the slapping, we can say that the school is liable. In that case, it would be argued that the school will be vicariously liable for the acts of its employee.

    However this was a domestic issue between two students done without the prior knowledge or consent of the school.

    The only possible cause of action I see is that they may argue that the school failed in its duty of care. But they will have to prove that the school was negligent in discharging their duties. I don't know how they will be able to prove that in court.

    I will love to see how it eventually plays out .

    1. Victim recounted that a teacher saw them in the first venue and asked what happened before she was taken to the second venue and the slapping continued. School is liable for enabling bullying and a toxic culture.
