Nigerian Law Concerning Breach Of 'Promise To Marry

If you are in Nigeria and someone promised to marry you and broke your heart, you can sue them!!!
“Breach of Promise to Marry” in Nigeria refers to a situation where one party, either the man or the woman, fails to honor their promise to marry the other. This is recognized under Nigerian law and the aggrieved party has the right to sue for damages. 

Two elements are necessary to constitute a breach of promise to marry:

  3. Enforceability of breach of promise to marry is almost impossible. In fact, this is one of the remnants of our British colonization, and should be totally expunged from our laws.
    If parties are free to divorce during a marriage, why on earth will they not be allowed to call off a relationship? The court cannot force a willing person on an unwilling partner.

    Issues of emotional and sexual incompatibility, differing lifestyles, domestic violence, dishonesty, fraud will always abound in relationships. It is therefore impossible to make an order for compensation over a justifiable reason.

    Also, what may be a deal breaker for Mr. A may not be for Mr. B. The court cannot project its own personal reasons on a party.

    2. I know of someone that was in a serious relationship with a guy and pumped in over a million naira into his building construction project, thinking she was building her future home. He also got her pregnant and wore asoebi with her siblings during her mother's burial.

      When she chop breakfast, she nearly ran mad. I remember she went to welfare then, about 15 years ago to file case. She definitely deserves compensation for her investment, as well as, regular child support. I felt sorry for her sha, this type of person has enough evidence to sue.

    2. Anon 15:40, it is not easy to enforce this in court. Even if a man promised a lady marriage and posted pictures, he has he right to change his mind.
      In fact there has been only one reported case where the court ruled on this and it was in the 1970s
