LEGAL ADVICE NEEDED
I have been a blog visitor since 2015, i think I have only commented once or twice with ****** and sometimes I take leave from here.
Ma'am please I need legal advice from bvs here
My company recently downsized it staffs, they scrapped my department promoted two of us from my department, formed a new department for six other guys then sent 30 guys home. I was suppose to resume my new position on the 1st of February which I did called the HR about to enquire for my posting all to no avail. I received a mail from them yesterday that my service is no longer required.BVs please how do I go about my current ordeal ?

The money you will use o get a Lawyer, please use it to sort out yourself and save for a rainy day, its not worth it at all, the unions dont protect the workers in Nigeria, if its abroad and they try this you will become RICH from suing them.... Also you did not sign a contract with them that protects you, even Job promotion is vague..
Please forget about suing them and look for another Job.....I am so sorry that this has happened to you.

DeleteJust to also add that there’s a public complaint commission (pcc). Google them, find one close to you and go make your complaint.

The people saying this cannot happen abroad have not worked for the white man. They do worse; employers abroad are perpetually in legal battles with employees.
DeleteAs a seasoned HR Professional with a decade experience, I am disappointed at most HR practitioners in Nigeria. we just rollout every junk company Management gives. What is the essence of been a strategic partner and an expert in the field? Gosh... this could have been handled way better. It is not rocket science that organizations layoff. all HR should do is negotiate a Good/fair payoff for the affected employees (an average of 2 months Salary) or the notice duration expected by company. Come clean with the staffs and see how to better support them. (e.g maintain HMO access for them for two months, Recommendation letters for future job applications etc).
DeleteBV someone is already offering to support you with your legal fees. Please seek a lawyer conversant and experienced with Nigeria Industrial Court. make sure you verify his/her claims. Do not waste time, efforts and resources with inexperienced lawyers.
Better still, go to Industrial court in your state of work, meet the clerks and ask for Good lawyers who have won cases in there.

I disagree with Stella on her submission. If we all chicken out of such thing, evil will persists! why should you get a promotional letter and when you requested for their expectation on the new post, they sent you a sack letter! Who does that? Nigeria is a sane country like any other countries of the world, only when we fight for our rights and demand justice!!!. So many Lawyers are waiting or better still, try HEMBELEMBE RADIO AND TELEVISION PROGRAM, at least, you deserve some severance package before being laid off like a chicken.

Well, as much as I agree with you, Stella is also right, because really the money to fight for your right in Nigeria can be used to set up something else; except your case is done pro bono. Secondly, if she is to fight, she must be well abreast of the labour/employment law in Nigeria side by side what is obtainable in her contract of employment. the Company cannot be dumb enough to fire anyone with clauses in an employment letter that will come back and bite.

Read your contract letter to confirm the terms of resignation or termination. Some companies pay one month salary in lieu of notice. C

ReplyDeletePlease before you people give her false hope. Read up. Under labour law, an employer can let you go for good reason, bad reason or no reason at all. So yes it is well within their rights to let you go.

Let other companies learn form the wotowoto that they will recieve. Their name will be on the internet for the wrong reasons and that is enough revenge .

ReplyDeletePlease refer to your offer letter of employment and check the terms and conditions of termination of employment and performance review clause in your offer letter. Go and get a good lawyer that will help you on this.. Did you sign the promotion letter? If yes, it is binding and will serve as a renewal of contract. Get copies of emails that were communicated to you on this promotion and other communication to back it up.
This is total wrong and laced with deceit. Poster take this to National Industrial Court...You will win this case..

If not, please consult a lawyer to know the possible options.
Please everyone always accept an offer from a company if you intend to work with them.
Accept offers by sending an email to the HR or whoever sent the letter, even if it does not state that you should.
Offer and acceptance creates a binding contract.
I will encourage you to sue. Save money for it and sue.
So sorry poster in this harsh economy. God will provide you with a better job.
ReplyDeleteYou need to read your contract and all addendums related to your employment from the first day of work, there is a termination clause that states what is required from both parties when cessation occurs however

ReplyDeleteDear Poster, before taking the costly lawyer route, take them Min of Labour & Employment Mediation office. The office is by Immigration office Alagbin area Ikoyi. They will handle your case. If nothing comes out of it or you are not satisfied, you can go to the Industrial Court. The Industrial Court usually refers cases to mediation

ReplyDeleteShe was to resume on the 1st of February, she called HR to no avail. Hence, she did not resume. She stayed home for approximately 3 weeks then she received a termination notice. Is this what happened??? If so, why didn’t she show up at HR in person? Sorry, I don’t get. I’ve been out of the workforce for a while. I guess I am not understanding, it seems to me, the poster was somewhat irresponsible by not following up on the start date for the new position. She should’ve been more proactive in getting more details about the new position and were to resume. Why didn’t she reach out to one of her team members for resumption details. Sounds like she was sacked because she never resumed.
Did she record her travails with HR and their lack of follow up to her questions?
Good question. I wondered about that too, because the letter says effective Feb 1. Why was she/he calling to know when to resume.
