ADVICE NEEDED


Good day Stella.


BVs please what is the best way to make my former employer remit my contributory pension to my pension administrator?.


 I worked for 16 years in this company before l was retrenched last year after lockdown. After retrenchment l went to my pension administrator and was shocked that my pension has not been remitted for 8years.


 This is the case of everyone that was laid off by the company. 

It's been a year plus since l got sacked. No pension, no gratuity has been paid to me. Please note that l did not commit any crime that caused the sack. I have honestly not had a single query in that company before the retrenchment letter.


 The owner of the company is a lawyer. People who resigned or were retrenched six years ago in the said company who decided to engage a lawyer are still in court. 

I do not have money for a lawyer. Please what can l.do? I am yet to secure another job. I need my pension and gratuity. I need the money to move on with my life. God bless you all.





*Such wickedness... I think this is the reason you were sacked.. Is there no regulatory body that you can report this company to?
I dont think they will pay you this money again, especially as you said that those this happened to 5 years ago are still in court.

Maybe you should drag the company on the social media......

    1. Sorry about your plight but what do you mean you were shocked your pension was not remitted for 8 years? Really? Didn't you know you are meant to receive remittance alerts on your phone just like your bank does?


      Anyways, pension contribution had replaced gratuity except your company policy says otherwise then you can have both pension and gratuity. Hope you have your payslips that clearly states how much was being deducted every month?

      If the total number of employees in the organization is leass than 15, then, the law doesn't really protect you... sadly so

      If more than 15, kindly report the employer in the nearest Pencom office close to you.

    2. I will tell u ma abi sir that u were careless not to have monitored your pension. Dnt u receive end of the month statement like ur bank send u.

      See that is the issue with most companies in Nigeria . Now if u are here and u work with a company! Try as much as possible to follow up with ur pension. If u are yet to get! Hv discussion with ur HR. Same tin i did for myself till i resigned. I sent couple of mails indicating since i opened my pension account i am yet to be paid! They keep ignoring. But trust me. I copied everyone i know. Including my Head of dept. Most companies does this! U will be surprised some staff hv been getting theirs nd some dnt. Becos if u dnt talk nd follow up! Themselves will keep quiet and be eating ur pension! Simple as dat. Na so naija companies be oo.

      I doubt u will get it thou. My dad dey laid off since more dan 10yrs with thi*sday newspaper based on their gratuity. The case still dey court e never get head till today.

      Lets not just read this post nd move.. if u are currently working nd u are entitled to these benefits. Better start to follow up on them. No just dey collect salary at the month end den u go house dey shine teeth o. A good pension company will send u alert like the way bank do nd also statement every month. Aunty i no know weather u go still fit ger this pension oo.

  4. Wickedness. Call the company out and don't sit back. Let those that were sacked come together to get a lawyer, it does not matter if the other ones is still in court,,God can do something for your own case.

  5. My dear, report them to Pencom AMD ensure you have your letter of employment and letter of retrenchment. They will not only pay you, they will also pay damages because it is statutory and Pencom is not going to take it lightly with them. I has the same experience and the company paid me fully when I threatened them with Pencom because they know the consequences. You cannot work for nothing and may God give you victory. Start by doing to tour PFA to make the report

  7. Report the case to National Pension Commission. They are the regulator in charge of pension matters. Report and ask for interest on all the years

  9. I don't know how reputable your pension administrator is, and how ready they are in helping out, but can you try liaising with them. You could meet up with them and ask them to help you call out, sue or demand that monies accruing to staff, both past and present be remitted as their business name is at stake.

    Let them tell your boss that the aforementioned staff have been threatening to call them out and possibly sue and that the staff think they are working with your boss to withhold payment. And he knows what that means. That they are not ready to jeopardize their goodwill just because of one client amongst other potential clients. You could also get other colleagues whose cases are in court to tow your line of reasoning. With massive pressure from court and the admin, he'll succumb. Or what do you think?

  10. Do not drag them on any social media. They know your financial capability and may decide to frustrate your life through bogus litigations.,hiding under libel as a charge. Report them to any human right organisation that has pro bono lawyers and then pray. Goodluck

  11. This is a very tricky situation. First for those still in service, make sure you always get your pension alert in addition to your salary alert on monthly basis. If you gave not yet set up your pension remittance alert run and go to do it now with your PFA, in that way you will monitor your company remittance directly. Regarding this, you will need a combination of petition to ICPC (it is a corrupt practice under ICPC Act), EFCC (it is a financial crime by your organization), PENCOM (it is against compliance regulations by PENCOM act), to ONBUSDMAN which is the Public Complaints Commission and Finally the most important write to FIRS because he cannot be issued a Tax clearance certificate without PENCOM compliance certificate which must show that he has remitted your pensions to the PFA

    1. Employers in Nigeria are smarter than the system. I have seen employers removing some existing employees from their schedule on ground that they resigned or got terminated. Some employer will not include a new hire in their pension remittance schedule at a critical time they want their FIRS certificate. Pencom works with what employers present as their employees'schedule to process their pension compliance certificate. Some employer will not update the schedule unless you take them by their balls to include your name for remittance. The system is flawed. You need your pension funds paid up to date? Get involved immediately you join. Dont wait for them to open pension account for you, do it yourself.

    3. My dear, I remember one company that tried it with my friend. I just wrote one letter to them copying 17 organizations quoting their TCC and NSITF numbers. They called him and paid him in full with abeg go and withdraw your letters. We also copied his Towns Union and Church Men association so that they know he is owing his staff

  12. Please, if you are currently working, ensure you confirm that your pension is been remitted. Don't wait till you resign or u are fired.You are excepted to have an app or an SMS showing a credit alert into your pension account at intervals, if you haven't gotten any and you have always had a deduction from your salary for pension this is the right time to cry out. it would be very difficult to fight it now without a lawyer

    1. The state government do not this. You only get alert from the one deducted from the salary but the one they are supposed to be paying monthly they don't. Hence them ending up paying teachers pittance after many years of retirement.

  13. I blame people. Don't stick to a job with all the signals that the job environment or the employer is not the right one. We endure too long and then cry foul if things are not going our way. What about people pulling colleagues down to gain favours?

    1. Thank you for this. I resigned 6 years ago. After seeing people toil for 20 years for a company sacked without prior notice and and gratuity/pension whatever. I made the decision I can't waste my early years in a one man business. Did I get another job? No offcourse but I'm into different business that cater to my needs and I'm okay with it especially being an Ehailing driver as a female. Lagos is stressful to drive a cab but being totally broke is disastrous. Take heart chronicle poster. Nigerian judicial system is porous. My former boss is a lawyer too

Report them to PENCOM , they will pay you all the outstanding but first of all go through your pension company who will write to your former company for the outstanding. when he refused to pay after they have written to him, report to PENCOM attaching your employment letter, retrenchment and the one your primary pension company wrote to them,

  19. I have written two times consecutively about employers in Nigeria not remitting pension. Poster, write to PENCOM and apply for 25% of your funds since you have stopped working. This is to force your PFA to pursue your employer to remit up until the date you were laid off. Just to let others know, our funds are not even save with some PFAs. This is Nigeria, where the government once announce that they will start borrowing from Pension accounts. Document your communication with PENCOM, PFA and your employer. Social media will serve as the last resort if PENCOM sleeps on your case. You do not need a lawyer. Download our Labour law and include the part of Pension in your letter to your employer. Include your pension statement while also stating the months your pension remittances stopped. Physically visit PENCOM office with your letter acknowledged. Get petty...That your Lawyer employer will pay.

  25. I don't think you will get that money again ooo. My sister just quit after working for one popular TV station for 5 years, I don't want to start mentioning name, but the working environment became so bad that she had to quit, the target she was supposed to meet was not forthcoming because the subscription was increased by about 70% in the midst of this pandemic and people where not subscribing. Her last take home was #25,000 and transportation to and from work is about #23,000 monthly she just had to quit. While she was working a certain percentage of her salary was being taken monthly as pension or is it insurance and she said she has about #300,000 in that account but she has no hope of getting any of the money because others that stopped before her did not get a dime. Maybe you should report to the pension commission maybe you might get lucky. Best of luck.

  27. Do you have proof that pension was deducted from your salary? If yes, the non remittance of it is pure stealing.

    The non payment of the employer's portion is a statutory offence.

    You have been well adviced above. But use social media ONLY as the very LAST option.

    Try this first. Gather all your proof. Settle the real amount your employer is owing you. Go and beg the man in person with your documentary evidence. Please go ONLY with photocopies and let your people know your whereabouts.

    Beg him to pay your entitlement not for a dash of cash and assure him of the confidentiality of payment received from him.

    If this fails, you may then report to PENCOM with solid documentary evidence as advised by other Bvs above.

  31. Most employers hardly pay pension and those that pay are not remitting their full contribution. My former employer is still owing me several months remittance. All this one man businesses are all guilty of this crime. God help us in this country!!
