Daddy Freeze was ordered to pay the money to Paul Odekina, who was married to Elechi at the time the adulterous act was committed.
In the Court documents obtained by The PUNCH, with the suit no PHC/403MC/2012, Mrs Benedicta Odekina is the Petitioner/Cross Respondent, while Mr Paul Odekina is 1st Respondent and Cross Petitioner while Ifedayo Olarinde (Freeze) is the Co-Respondent.
The presiding judge, Hon Justice Akpughunum, ruled that the OAP pay the sum of N5m as “damages for depriving Odekina amiable consort of his wife”.
The document read in part, “The sum of N5,000,000 is awarded against Ifedayo Olarinde (the 2nd Cross Respondent to the Cross Petition) as damages for depriving the Cross Petitioner of the amiable consort of his wife (Petitioner/1st Cross Respondent) and for injury suffered as a result of his adultery with the Petitioner/Cross Respondent.
“An Order of injunction is hereby granted, preventing Ifedayo Olarinde ― the Co-Respondent to the Cross Petition ― from having access or dealing whatsoever with the children of the marriage until they attain the age of majority.”
The Judge then proceeded to dissolve the marriage between Paul and Benedicta due to Benedicta’s adulterous act with Daddy Freeze.
“An order of Decree Nisi is hereby granted, dissolving the marriage contracted between Paul Ochenu Odekina and Benedicta Nkemdilim Elechi-Agunabo on the 26/1/2002 at the Chaplaincy of the Holy Rosary CIWA at Port Harcourt on the ground that the marriage has been broken down irretrievably by reason of the Petitioner/ Cross respondent having committed adultery and intolerable behaviour of the Petitioner/ Cross Respondent which the Respondent cannot be expected to live with the Petitioner/Cross Respondent,” the document read.
However, Paul was granted custody of the children produced in the marriage and Benedicta was ordered to hand over the children’s passports and birth certificates.
*I hope he responds to tell his side of the story cos this is shocking..
I recall reading an interview where the lady claimed her ex was gay but she didn't know it before marriage. Was she lying about that? Why didn't the court take that into consideration?

For instance, the law does not recognize juju and You cannot prove that someone used juju to kill another person, so no judgement for you.

ReplyDeleteYes you can. Most times it is very difficult to prove hence why most would want to file for divorce without hassles. Once there is an allegation of adultery with specific facts, the adulterer would be joined in the suit as a co respondent and would be made to pay heavy damages because you are the reason the couple isn't having sex. Cessation of consummation can also be a ground for divorce.
DeleteOnce adultery is proved, it assumed that the partner who is found wanting would not be awarded custody of the children because it now established that the partner lacks the moral standing to bring up the children right. This is exactly what played out in this case. Who would want to award custody of the children to this respondent. Even if she's awarded custody, can she be trusted to bring the children up in an upright manner. These are the things the judge took into consideration before granting custody of the children to the Petitioner Mr. Odekina.

The laws in Nigeria is very weird. Adultery should only be used as a ground for divorce and not jail time or fine payments.
ReplyDeleteThe judge didn't award that fine in his own without the ex asking for it as a pay for damages incurred in the marriage. He has a right of appeal though but I doubt if he will succeed.
