Who sent him to have sex? The company will have to pay for his misconduct and indiscipline now. Albeit, written down rules and regulations refraining employees from having sex during a business trip and on work hours will safe companies from such issues.
The court maybe ruled on a technicality. The lawyer probably argued that if the company didn't send him on a trip, he would be at home with his wife instead and not with a stranger and he would still be alive. Lol
Gotta love American and European justice system is a joy to watch and you would be proud to be a lawyer.
