Amacastel - don't go there cos actually, it's possible for a person, A in a UK court to enter a defence of provocation (and use it as a basis for self-defence) when the attacked or dead party, B is asleep. R v Ahluwalia. Some Nigerian case law (in terms of the principle that comes out of it) is based on the English ones. I'm saying that's what happened here; I'm saying "he was asleep" may not be enough to prove she lied.

DeleteThe principle of provocation I submit rests on reaction at the spur of the moment, in other words, spontaneous reaction.
You cannot advance the defence of provocation after vacating the scene of the incident e.g go and take a cup of tea after the provocation and return to deal the fatal blow, or go outside to smoke a cigarette and return to deal the fatal blow.
This is a clear case of premeditated murder.
This is not a case of cumulative provocation as pleaded in the alhuwalia’s case.
@anonymous 15:05, sweetheart, the Nigerian criminal law is almost identical with that of the British criminal law. There are just a few variations. You cannot plead both provocation and self defense in a case of murder, provocation is distinct from self defence. You either plead provocation or self defence. You cannot enter a defence of provocation and use it as a basis of self defence. That's actually a legal impossibility that cannot stand.
DeleteA defence of provocation means that the act was carried out in the spur of the moment, in the heat of passion, before passion cools off. A knee-jerk reaction of some sort and not premeditated. The retaliation must also be proportionate to the cause of the provocation. You can't stab a man to death because you walked in on him stealing a piece of meat from your pot. That is clearly an overkill. However if you walk in on a man raping your wife and you react immediately, that is a clear case of provocation.
Unlike provocation which is more like an excuse, self defence is more or less a justification, erasing the criminal liability in murder. Self defence is the use of reasonable force to defend yourself or a loved one when you reasonably believe that your life or that of a loved one is in imminent danger. I hope you now see the difference?
If you are well abreast with this case, you will realise that it was neither a case of provocation nor self defence. Premeditation and malice were clearly established. The minute you attack someone who is asleep, all bets are off. Even the vilest criminal looks relatively harmless while asleep. She should have reacted to whatever he did to provoke her the minute he did it. Waiting for him to fall asleep clearly shows premeditation. Of course, it is ludicrous to say you were defending yourself against a man asleep. There was clearly no immediate danger.

My former neighbor slaps her husband at any point of argument.The man said it is shameful for him to tell people the wife abuse him. She did one and hit his head on the wall. Since then the man has been in and out of Aro.

This clemency she was granted, is a slap on the Victim’s family. It’s just too soon. Anyway, she will have to deal with the consequences of her actions that fateful night. Is she not the Lawyer?? Women, if your husband gets physical with you or cheats in your face, please leave. No need fighting or taking a life. No man or woman, is worth a day in Jail/Prison.

ReplyDeleteSince the news is out that she has been granted clemency, the new governor should ask the court of law to reopen the case and send her back to where she belongs. So because her father has connections, does that mean she can kill and not do the time? If it’s like that, she will kill again knowing her father has connections.

People that knew her personally like former mates in secondary sch & uni,bar and bench have spoken of her exemplary behaviour , so I wonder why some people fail to give her ,the judge hat gave the judgement or even the governor that gave the clemency the benefit of doubt regarding the details of the case which the general public is not privy to.

Unbelievable! The justice system is just for the poor and unconnected in this country. A clear case of premeditated murder and she receives a slap on the wrist judgement? She thinks she has escaped her due rewards but may her life never be ok. What a painful thing for the man's family to face and to have justice denied them like this is not fair.

If she had served the full jail term of mere 7 years that 'might' have been somewhat justice for the deceased (if her lawyers were able to prove beyond reasonable doubt that it was under accumulated provocation which interfered with her sanity).
ReplyDeleteThis woman could have just done the deceased bodily harm that is not grievous (break his leg or arm)... but... she Chose to let her anger drive her to stab not once, twice on two consecutive days.
That is premeditated MURDER and should have earned her life imprisonment.
Her action was not proven to be by reason of insanity.
For those that said she was quiet and had an examplary behaviour, it could have been on the surface.
Maybe she handles her anger, disappointments from actions of other people by silenting venting (killing or stabbing them in her imagination).
Then one day, in marriage she actually did that.
If you cannot take something in marriage or a situation, please walk away. Do not take a life you cannot create. It's an irreparable loss to the mother that bore the family after conceiving and raising a child. A miscarriage is never forgotten let alone a child you held in your arms and raised.
EVERY ACTION STARTS WITH A THOUGHT. Meditation on sane thought for long will propel action.
