Inspector General Of Police Ibrahim Idris Sued For Contempt Of Court

Is the Inspector General of Police above the law?






Personal Assistant on Political Matters to Governor Abdulfatah Ahmed, Mr. Olalekan Alabi, has filed an application before a Kwara State High Court sitting in Ilorin, seeking to commence committal proceedings against the Inspector-General of Police (IGP), Ibrahim Idris, for contempt of court.


Alabi approached the court through his counsel, Adebayo Adelodun (SAN), to effect service of Form 49, a notice of committal to prison on the IGP for disobeying the court order directing his (Alabi) release from police custody.


The service of Form 49 on the IGP meant that he would be summoned by the court to show cause why he should not be committed to prison for disobeying the order of court to release Alabi.


Alabi had been in police custody in Abuja since May 30, following his arrest over an alleged link with suspects arrested over the April 5, 2018, Offa banks robbery. However, on Wednesday, 1st August, 2018, Kwara State high court had granted him an interim bail after declaring that his continued detention by the police was illegal and unjustifiable.


While granting him an interim bail in the sum of N20 million with two sureties in like sum, Justice A. I. Yusuf, held that the police had failed to justify why they had kept the applicant in detention for over two months. But despite the court order and the perfection of his bail conditions, the police had refused to release him from its custody. This development necessitated the court on 14th August, 2018 to issue Form 48 to the IGP, which was an initiation of contempt proceeding.


It reads that; “Take notice that unless you obey the directions contained in the order of the high court of justice of Kwara State delivered on the 1st of August, 2018, you will be guilty of contempt of court and will be liable to be committed to prison.

The IGP has, however, failed to respond to the notice, prompting Alabi to approach the court to serve him Form 49.

  1. Abuse of the judiciary didn't start today but this government made it their priority. On six different occasions Dasuki was granted bail but Mr President and the one that called himself Malami refused. The same thing to El Zazaki or what they called him.

    It is against civility for a government to flout it owns law but Mr President Mohammed Buhari don't give a damn. Too bad for our democracy.

  5. The level of impunity witnessed in this regime is a RED FLAG, from Muhammed Buahri to his subordinates. Buhari has no respect for the rule of law, a retired army officer! His foot soldiers are following in his footsteps,after all nothing can be done to them.
