Nnamdi Kanu’s Surety Drags Him To Court And Seeks For His Arrest

One of the three persons who stood as a surety to secure bail for the leader of the Indigenous People of Biafra, Nnamdi Kanu, Tochukwu Uchendu, has filed an application demanding the arrest of the IPOB leader.




The two other sureties are Senator Enyinnaya Abaribe and Ben Elshalom, a Jewish priest.

At Monday’s proceeding, Abaribe and the two others were told to produce the IPOB leader or go to jail.

The motion on notice was brought pursuant to Section 174(A) and (B), 177, and 179 of the Administration of Criminal Justice Act 2015, and Section 36I and 6(6) of the 1999 Constitution as amended.


The motion filed by Frank Chude on behalf of Uchendu is seeking “an order directing the Nigerian Police to Arrest and produce Nnamdi Kanu before the court.”

Uchendu also wants an order suspending his obligation on the bond until the whereabouts of Kanu is established.

Uchendu predicated his motion on the grounds that the court had granted the 1st defendant (Kanu) bail on the 25th day of April, 2017.


He pointed out that while Kanu was on bail; he had a confrontation with the military, an arm of the state, and “that since then his whereabout is unknown and he has not being seen”.


An affidavit deposed to by Uchendu, stated that after the invasion of the residence of Kanu by the Nigerian Army on September 14, 2017, he has not been seen in the public since.


“I am unable to communicate with the 1st defendant and his whereabout unknown to me.


Uchendu averred that Kanu had brought an application before this court seeking an order of habeas corpus for him to be produced in suit no. FHC/ABJ/CS/908/17.

“That Kanu has not been seen in public since the 14th day of September, 2017, when the agents of the state (soldiers) invaded his house in Isiama Afaraukwu, Abia State.

“That the invasion of Kanu’s home on 14th September by the military has ostensibly frustrated his bail and made it impossible for me to bring him to court as stipulated by the terms of the bail.

Uchendu therefore pleaded the court not to punish him for the unforeseen circumstances created by the Nigerian soldiers which has practically frustrated his duty as surety.

  1. This news didn't started very well. The caption is misleading and I know it is handiwork of the Nigerian press. The Nigerian press won't report that Justice Binta Nyako has proven to the world that she has nothing to do with Abaribe gestapo arrest by the DSS. That is has nothing to do with Kanu case.

    What does that tells you? The government arrested Abaribe for exposing their fraud in the upper
    chamber for the inclusion of 30billion into the budget. So many grey area in the just passed budget. We are not that foolish, we understand everything happening.

    1. Uncle, what are you even saying? Does it make sense to you? Why are you here trying to defend a criminal like Abaribe? A person with no political credibility in his own state. Look at his history till he became a senator? What did he expose in the new budget? Is it the additional 9 constituency projects he had to his own constituency projects in the new budget? Did he talk about those ones? Did he execute the projects he takes monthly allocation for? The same man reported false alarm about the Enugu airport project which was reduced by the Senate. Don’t forget that Sen Ekweremadu reported two statements in conflict and in contradiction to what Abaribe claimed. Stop coming here to talk nonsense because of your support for Nnamdi Kanu, a criminal and failed DJ in the UK who came to endanger the lives of young people in the East. Why is Nnamdi’s father alive? Was he not there when the soldiers attacked? Was it not the same house Nnamdi Kanu was living in? Did Nnamdi’s brother not claim that they were not going to disclose his whereabout few days after the friction with the soldiers? And please, learn how to use your tenses properly. Stella use the headline there but you are busy attacking media.

    2. Don't mind the clowns. Nnamdi Kanu's dad who is an old man survived andnishale and hearty. The family spokesman had virtually acknowledged that Nnamdi Kanu was alive but they now want to try a futile and childish lie that the Federal Govt is holding him orgasm even killed him.

    4. Shebi that day I opened fire on pro-biafrans and their deceitfulness on this blog, they came out as usual arguing through their anus, looking for who to call names in their frustration. I wonder why they are quiet now. I expect that they should produce him since he is a great leader. Empty Barrells!!!

      The Nnamdi has shown them what it means to be a real scam, same way the first leader who died did (wont call his name cos I wont speak evil of the dead). They make people shed innocent blood for their selfish cause, and when the heat becomes too much, they retreat and run into hiding. They are their families remain safe for generations sef.
