Mercy Aigbe Versus Bride Versus Designer Rikatobyme

The Ongoing red dress Brouhaha between actress Mercy Aigbe,Designer Rikatobyme and the Bride Lawrentta who was let down on her wedding day is getting messier with lawsuits flying left, right and centre....

The Lawyers on this Blog should explain to us if the Bride has a case suing the designer and mentioning Mercy Aigbe in her suit.

We also need to know if Mercy had any right slamming the Bride with a lawsuit and giving her a seven day Ultimatum........

All we have seen so far so good are rants from all parties involved and a half baked Apology from Rikatobyme to the Bride and to Mercy..

What does the Law say concerning this?Who has a better case according to the Law?
Who do you support?

I am on the side of the Bride but think she should not have involved Mercy directly without proof that Mercy knew that the dress was a wedding dress...she might not have known and thats the truth....

Lets Discuss this.....

    1. A MUST READ!!!
Another dictionary meaning of 'connive'- is to pretend to be ignorant of something in order to escape blame; to ignore a fault deliberately. So she is right to say Mercy Aigbe connived with the designer by collecting a dress that isn't hers.
From the designer's statement, Mercy brought her material but never stated that it's exactly the same as the bride's material. By implication, it means they are different. It is also worthy of note that Mercy and the bride don't have the same body measurement. So, if what the designer gave you isn't yours(different material and size) you should have asked questions thoroughly because ignorance is not an excuse (Although Mercy wore it despite the fact that it's not her size, without making a case because I don't see the reason why I'll give you a material I want to use for my 40th birthday and then you give me a dress made with another fabric and a different design) or did she also give the exact design the bride gave?, and then i accept it willingly without a PERFECT EXPLANATION.
So my fellow blog visitors, going by the above definition and assertion, the bride has the right to say she connived with the designer. Permit me to tell you that even if the client in question wasn't Mercy Aigbe, in her lawsuit going by the above assertion, she would still mention the client's name (that's if she discovers the name of the client) as conniving with the designer.

If on the other hand, the designer served Mercy Aigbe a good explanation without mentioning the fact that the dress was for someone else, then you should sue the designer for lying to you and bringing about an embarrassing situation of this kind which is detrimental to your reputation( Also causing you a defamation of name).

After Mercy Aigbe have done the above, the designer Rikatobyme should on her own part determine how the mix up came about. If she claims she gave Mercy Aigbe the gown mistakenly probably through her stylist, and Mercy upon discovering that the dress is a different style from what she indicated through her stylist and was made with a different fabric( common sense will tell you instantly that the dress is for a different client of the designer) didn't alert her for immediate rectification but instead went ahead to do photoshoot with it, makes her guilty of knowingly and willingly converting someone's legal property( oh yes! material was bought by the bride and service charge was paid in full) which is against the law. Based on the above assertion, the designer Rikatobyme can sue Mercy Aigbe.
I hope I've bn able to convince you and not to confuse you that the bride's lawyer is not wrong.

  2. I am also of the opinion that she could have sued without involving mercy because until otherwise proved, there's no way one can tell for sure if Mercy knew the dress belonged to another

    1. What more proof does she need? The designer mentioned Mercy. She is culpable.
Mercy is a liar. Her past shenanigans attests to that. A fucking smooth liar. But hey she's an actress.

  3. I'm not a legal practitioner but the bride has a case.
Is the bride the owner of the dress? Yes
Was Mercy aware of this? -Ignorance is not an excuse in the court of law.

    2. Because ehhh it's not hers and it's currently causing a controversy? Any sensible person would take it off, she looks belligerent keeping that picture on her profile.

  5. I’m no lawyer but the bride fumbled by mentioning Mercy’s name in the whole brouhaha. The contract was between her and her tailor: “Sew the dress and I pay you money”. The tailor breached the contract by giving or selling the said dress to Mercy, even after payment had been made. Her grievance should be towards her tailor. Even if Mercy knew it was someone else’s wedding dress and offered to pay triple for the money, the bride cannot still sue or drag her to court. Infact Mercy can decide to sew the bride for slander lol because this whole issue really doesn’t concern her. The business was between her and Rikatobi or whatever her name is. It was in the Tailor’s place to not give Mercy the dress after all she did not break into her shop to steal the dress. Shikena!

  6. The bride has a case. Others don't with her. Mercy can only have a case with the tailor.

The tailor mentioned mercy brought a red fabric to her and that was why she made a mistake. Now this implicated mercy. It meant mercy was at the place of her business, which means she probably saw the other red dress and loved it.

Now mercy is saying she has never met the tailor. So mercy should sue the tailor who mentioned her name. As the bride sued mercy in link with the tailor seeing the tailor mentioned mercy bringing a similar red fabrics

    Infact, I don't know what I'm saying

But I know the bride has a case against the designer and mercy if she can prove that mercy was in the place of business of the tailor 😕😕😕

    Lawyers, your job is hard

    1. Correct. The tailor was the first to implicate Mercy. The tailor said Mercy gave her a similar material to sew and a mix-up happened. Why did Mercy not raise an alarm then.why has she not sued the tailor for telling lies against her. Mercy is just bitter that the bride had the guts to call everyone out like that.
Dear Mercy what is in that lawsuit that we've not heard before abi did you not wear somebody dress? Lol. Park one side Abeg

  7. I'm not a lawyer but I think the bride shouldn't have mentioned Mercy's name until she has proof that Mercy knew.

  8. The bride has every reason to sue for breach of agreement and contract.

Mercy has to be involved because she was in the dress.
It cannot be ascertained if both Mercy and the designer connived to carry out the fraudulent act hence she is an alleged accomplice to fraud.

    1. She could have only mentioned that the said dress was found with mercy not that she was in connivance with the tailor

    2. Eka, Mercy has to prove beyond every reasonable doubt that she knew nothing about the dress. Making a statement via interview is not concrete enough.

The dress she was wearing and stood gallant in on her 40th has every indication that it belonged to Retty. As concrete proof indicating so, is the designer agreeing to the fact in a statement saying there was a "mix up" as she gave the bride's dress to Mercy. (Evidence)

Mercy on her own account "claimed" she got a stylist to source for her dresses and knew nothing about how or what came to her.

Now my question is, is it possible for a celebrant to get on any dress offered to her when she has time and option to choose what she would love to see herself in for an event much celebrated as her 40th?

Most often the case, most stylists show their client dresses via photos or physical appearance for approval. Except at this point the blame is about to take a paradigm shift from Mercy to the stylist which leaves us with the second question.
      - Did the designer show the stylist the bride's dress and both agreed to con the bride off her dress for Mercy's use?

You see, Much as 95% blame goes to the designer, we must not rule out the 5% chance that Mercy(and or her stylist) did not scheme with the designer to have the bride's dress as against another probably offered to her.

As it is now, the heat has been doubled on the designer-Rikaotobyme.
Mercy should get her own lawyer too to prove her innocence in all of these and as well sue the designer for character defamation and mud slinging.

This designer aka Rikaotobyme is in hot pepper soup

    6. Bloglord this is a civil case, one does not need proof beyond reasonable doubt here. That's for criminal cases.
The bride should focus on the person she had the contract with, her tailor, and sue that one. She could involve Mercy so it can be known that it was on this person that her dress was on.
The tailor didn't do well at all, you don't do such at all, talk less of when it's someone's wedding. Reminds me of a makeup artist that collected serious money from a bride, and on the day of the even claimed illness and sent a half baked associate. Turns out the MUA was at another event doing the makeup of someone else.

  10. I don tire sef. Can this rikabumbum just tender sincere apologies to the bride, make it public and just compensate her heavily. It won't have ever gotten to it.
This may have still saved her business name. Because there is no way anyone in her right senses will trust her with their wedding gown
But she had to do big girls.
She just seems rude, proud and badly behaved.

  11. The bride had every right to mention Mercy. Because long and short of it is that mercy wore her dress.mercy must explain to the court how she came about the dress. Let the designer show us the fabric mercy brought that caused her to mix up both outfits. And why did mercy accept another persons dress. And yes the bride was right the dress is her 'legal property'. Olodo mercy.

    2. The bride has the right to mention Mercy as Mercy wore her dress but no right to assert that she willfully connived with the designer as she doesn't know that for sure, neither does she have evidence of that.

Mercy can sue for defamation thereby making the case more messy and prolonged and the bride may end up not getting adequate compensation because of all the technicalities that will be placed before the court.

Bride should have focused on what she knows, designer messed me up at my wedding after taking my money, I saw my dress on a celebrity, designer should explain why and compensate me. Shikena.

      I am a lawyer.

  12. Stella, you're right. I'm no lawyer or even close but some things are just common sense and discretion. Nigerians just talk anyhow sometimes. The bride should not have involved mercy without proof that mercy knew about the dress. Mercy can deny she doesn't know and she would have a point. Because its actually possible she didn't know the dress was for someone else especially as the designer had a model wear it for a shoot before mercy did.

Anyway, most people don't have common sense so it's allowed.

As for the rikawhatever she's is just a greedy bitch. All these people who feel smart and end up fooling themselves in the end. She should return the money for dress and fabric to the bride and stop this nonsense. Look how her business name is dragged in the mud over her own stupidity.

And the bride has no other business with the other client (Mercy). Face the dressmaker!!!

  13. Why will the bride mention Mercy's name??
Its not right..mercy even apologized when she noticed it was a bride's cloth.. So mercy also has a case

  14. Mercy is a part of that suit whether she likes it or not. The bride saw the dress on her. If she says she has nothing to do with the dress, then she should mention the name of the middle man/ woman/person who collected the dress from the designer and took it to Mercy.

In fact, Mercy should be called to court to come and give evidence o jare! We want to know if she held the dress back and the designer was unable to collect it and return it in time to the bride which caused this debacle.

    1. There was a material bought by bride for her after wedding outfit
    2. Bride gave material to tailor - oops designer
    3. Designer gave dress to Mercy
    4. Mercy wore dress for photoshot and the whole world saw the dress
    5. Mercy was unable to deliver dress back to designer so she could in turn deliver to bride...
    6. Designer was unable to deliver dress to bride, sold her a cock and bull story and delivered a second alternative dress to bride to wear as her second outfit
    7. Bride saw dress made with her material by designer on Mercy 40th birthday photoshot pictures.
    8. Bride cried out! Mercy stayed silent, Designer stayed silent and gave half hearted apology after second thoughts with another cock and bull story

Oh yes! Mercy is culpable. It was not her dress. She did not buy it - either material or dress or pay some form of consideration for wearing it. Mercy should be called as a hostile witness by the bride's counsel. The story is not complete without her (Mercy) and she is entwined no matter how hard she tries to separate herself from it...

This one is not a matter of "wore a dress without proof that she knew she was wearing someone's wedding dress". She wore someone's dress - end of story whether it was sourced personally or by another person. If it was not sourced by Mercy personally, why is she not mentioning the name of the person who sourced the dress for her?

  15. Mercy is the link to the tailor's default in providing the dress to the bride. She is the reason the designer could not deliver the dress to the bride. Methinks she is involved heavily. The case or claim is not complete without Mercy. No way she ~(Mercy) can wiggle out of this

    ReplyDelete
  16. They should just end it already

    ReplyDelete
  17. Bride has no case against mercy. Bride could have joined mercy to the suit as a possible third party without stating any allegations against her. Clearly the lawyers want mercy involved because chances her she is deeper pocket. You always want to drag I the person that can pay. But a smart lawyer will "add" the person by stating possible allegations and that more discovery is necessary to ascertain allegations.

  18. Stella mercy doesn't have any case o. She shouldn't put herself in trouble. You know Why? The dress didn't fit. Based on the photos and all. It was obvious she didn't zip it up. Based on the angles the photos were taken. If I were mercy I'll thread with caution. The bride shouldn't back down.

  19. I'm a traditional lawyer by the order of the ancestors. The bride did no wrong in mentioning Mercy's name as far as there's enough evidence that Mercy wore the exact dress meant for her.Mercy has no locus standi to take the bride to court, she only has that right against the yeye designer.

I am just looking at the comments absolving mercy, like how na?
I paid for something and saw it with someone else, even making money on top of the dress. She is implicated whether she likes it or not. She should have apologized and pulled down the pics immediately this news broke.Instead she left the pics and was forming macho. That shows premeditation. She anticipated the fallout and was well prepared for it. Do you know that your actions after a crime also determines the verdict passed? Even if mercy wore an exact replica, the bride can still sue for theft of intellectual property.
Chikito, its not a matter of common sense. Law is not by common sense, its by evidence presented, cases argued, precedence, etc, so please don't say that people implicating Mercy dont have common sense
