Embattled Nollywood actress mercy Aigbe has been dragged to court by one Opemititi Ajayi who was accused of allegedly breaking the actress' marriage. She is demanding N500million as damages...
Her lawyer Afolabi Fashanu & Co has written to Mercy over defamation of character of its client.
Recall that in an interview with Broadway TV, Mercy Aigbe was quoted to have claimed her husband slept with Miss Opemititi and was responsible for the break down of her Marriage.
The complaint's lawyers have demanded a retraction and public apology from Mercy Aigbe tagging all her social media handles......
The Letter was sent May 15th and Mercy has 7 days to comply.
It expires in two days.

Do you know that when you use someone, you have to raise the amount of money because the judge is going to reduce it if you eventually win the case. She might sue for 500m but at the end of the day she might be rewarded 10m.Please try and educate yourself, life doesn't start and end on a blog. And also if Mercy said the Opemititi was her bestfriend, this one is saying she was never Mercy's best friend, how do you relate both statements. Stupid case and which lawyer wrote this letter?
ReplyDeleteA defamation suit is tricky, it's not as straight forward as one may imagine. Until Ope proves the existence of libellous or slanderous words peddled by Mercy; and as a result her reputation has been tarnished or she has suffered some form of harm which was Mercy's intention, by law Mercy is not required to prove anything.
ReplyDeleteIt is only when Ope has proved her claim of defamation to the satisfaction of the court that Mercy now has to defend herself by entering a defence of justification, i.e, that the defamatory words are true. Proving that defamatory words exist is not the challenging part, after all it's all over social media. Proving that those words were injurious to her character and reputation, therein lies the challenge.
She will have to call at least one witness and tender into evidence at least one Exhibit, documentary or otherwise, to show the damage done to her reputation. For example, the witness will testify how he/she no longer wants to be in any relationship whatsoever with Ope because of those scandalous words. Or Ope can testify herself and show the court how those words drastically affected her livelihood/business or family life. The damage to her reputation has to be proved and that can be very difficult. Which is one of the reasons people merely threaten to sue but never really do or they start the proceedings but later settle out of court.
To an extent, you have to be squeaky clean before you slam someone with a defamation suit because once you lead evidence to show your good character, you've just yanked open the proverbial Pandora's box. The person you sued now has the right to lead evidence challenging your so called good character. So all the freaky lil' skeletons in your closet are gonna come out to play. It's one of those funny scenarios where the "oppressed" can end up being the bad guy while the "oppressor" waltzes out smelling roses. Like I always say,civil cases are not necessarily worn by who is telling the truth, they are worn by who tells the more convincing story, which may be lies. In court, a well told lie trumps a poorly told truth, especially in civil matters.
