WHAT IF YOU WERE EITHER THE MAN OR THE MAN IN THIS STORY?
One morning, the woman was trying to tidy up her husband's desk in his home office, as routine chore. She saw a yellow document with court stamps on it. What surprised her was that her name and her husband's name were written on the document as Mrs. versus Mr. As she looked further she saw the word "ORDER" boldly written on it.
It was a divorce certificate, her own divorce certificate. She discovered that according to the certificate, the wife (that is her) had gone to court to ask for divorce from her husband and the court granted the divorce and stated: "The marriage between Mr and Mrs, is hereby dissolved." This woman nearly fainted.
She snapped the certificate with her phone camera. Let's say it turned out that this man had reasons to prove that he is no longer married to this woman. He was up to something sinister. He needed a divorce certificate. He planned with another woman for that woman to answer the name of his wife. They all filed the paper without the real wife knowing.
When the case came up in court, the woman, impersonating the wife, stood up and answered the wife. And the man was there and he answered for himself. The Court asked the woman if she really wanted divorce, and she said yes. They asked the man what he wanted and he said he too wanted divorce. They couple have three children - two girls and one boy. The Court asked the woman what she wanted to happen to the children, and she said the children should be given to the man that she did not want to see them again. The judge asked her if she was sure of that and she said yes. The court granted divorce and awarded custody of the children to the man. Shakena!
This woman is looking at this divorce certificate. She knew she never filed any. She knew she never went to court. She knew that her husband never even mentioned to her that he wanted divorce. This is happening now in Nigeria and DPA is looking into it.
What will you do if this was your case? Before you react, note that the Nigerian courts do not have cameras and cannot tell whether this woman was the one that came to the court or not. The judge sees many people and after three months, the judge cannot identify the woman that appeared before him. So, it is not easy to show that it was not this woman that came to court on that date.

I don't think they need to go to court to do it..they arrange it at d local government registry..Daz where I went to enquire and they told me to bring 30k for d coded dissolution of d marriage.

ReplyDeleteThe court can't just arrive at a divorce judgment like that, they need proof if there was actually a marriage (legal) and proof of pictures, the court must also carry out investigations on whether the divorce can be granted based on what ground?( what are the circumstances surrounding it) and whether it suffices enough to grant a divorce.
ReplyDeleteWell this man might actually do this with any lawyer print out papers and get it signed which will still carry the court stamp on it #thats the level of how corruption has eaten deep into our society# cos I have a case of a woman impersonating another person as the land owner the real owner of the land is actually alive but some how they got another woman to act like the original owner in selling of the land and they paid her off.

ReplyDeleteA man got involved in an accident or so. His family was contacted and two women claiming to be his wife showed up. Mind you both had kids for him and both were legally married to him. So they thought. But both living in different states. One was his high school sweetheart married to him for 20yrs. The other lady they have been married for 10yrs. He will spend mon to Fri with one and weekend with another one. Claiming he is working out of state. He spent weekdays with the 2nd wife and weekend with first wife.
He actually had divorced the first wife without informing her,just to marry the 2nd wife legally.
He got someone to impersonate the first wife and act as her in the court for divorce. He taught the person how to sign her signature.
It's a long story let me stop here jare.

The husband on the other hand just spends her money and sit at home allday. She travelled out of d country to get some goods, few days later, she called her children complaining abt not getting through to her husband, their father on fone. They told her that they dont know the whereabout of their Dad as well, she was disturbed and had to come back home. After she got to Nigeria, she looked everywhere, she couldnt find him, until a friend of his told her the husband has gone out of d country with his side chick. She was pained, she needed money too to sort her goods and all, she then proceeded to the bank to make withdrawals. She got to the bank and some staff she was friendly with all looked at her strangely, then she went to the manager s office, he nearly ran out when he saw her, the confused woman was getting confused the more, then the manager said, but madam u r supposed to be dead, the woman said what do u mean? He then told her the husband came to the bank, told them the wife was dead, cleared out the account cos the account was joint, he even showed her obituary the husband presented with other documents. ReplyDeleteThis story has too many irregularities, seems more like a hypothetical situation. I doubt its authenticity but if it's true then the proceedings were held in a Customary Court, which means it was a traditional marriage. You can't have this caricature at the High Courts. High Courts abide by the Matrimonial Causes Act and the grounds for divorce are clearly stated. No High Court judge will grant a divorce petition because both parties are no longer interested in the marriage. Besides, even if the petitioner "miraculously" convinces the Court to grant the divorce petition, the first order will be a "decree nisi", followed by "decree infinite" which comes 6 months after. It takes time. It's at the customary Court that a marriage can be dissolved because both parties and no longer interested in the marriage.
ReplyDeleteAnother point is, no judge will ask about the custody of the children because the issue of custody ought to have been added as one of the reliefs in the petition. The judge will then interview the to hear from them in order to make the right decision. This story doesn't add up.
Anyway, let's say it's a true story, for argument sake. It's a pretty straightforward remedy. The wife should file a motion on notice for the Court to set aside it's judgment because it is a default judgment for all intents and purposes. A judgement given in the absence of the real party is voidable and can be set aside. Secondly, a court has the power to set aside its judgment if the Court was misled and the judgment obtained by fraud. All the lady needs to do is file an affidavit stating all the facts to support the motion for setting aside the judgment, then annex her proof of marriage like wedding pictures, Newspaper showing her change of name, family pictures with the kids, etc as Exhibits.
Once the Court sees that its judgment was obtained by fraud, it will not hesitate to set in aside. Oh! I pity the husband because by the time the court is through with him, he will end up in prison for perjury,obstruction of justice, conspiracy to commit a felony et al. While the "actress" will follow suit for impersonation plus all the aforementioned offences. The hubby has no idea of the gravity of what he did.
