Ibru Siblings In Property And Paternity Battle

Five months after the death of frontline businessman Chief Olorogun Michael Ibru, 16 of his children are in a legal tussle over their paternity and over his multi-billion naira assets.



One of his sons, Oboden Ibru, has approached the Igbosere High Court, Lagos, for a declaration, among others, that he and his 15 other siblings are entitled to the estate of their father.

In a counter-claim, one of the late Chief Ibru’s daughters, Janet Ibru, urged the court to declare that only persons whose paternity are confirmed by a diagnostics centre in the United States are entitled to an equal share of the estate.

Oboden’s suit was filed February 8 by Chief Bolaji Ayorinde (SAN) but has not been assigned to a Judge.

The defendants are Oskar Ibru, Peter Ibru, Emmanuel Ibru, Gloria Ibru, Elaine Ibru-Mukoro, Elvina Ibru, Mamemo Ibru, Janet Ibru, Obaro Ibru, Vivi Ibru-Stankov, Edesiri Ibru, Christiana Ibru, Jero Ibru, Vikwesiri Ibru, Gabriel Ibru and the Probate Registrar, High Court of Lagos State.


The claimant is seeking an order declaring that a Memorandum of Understanding (MOU) of January 2, 2001 is valid as to the distribution by way of gift of the late Ibru’s assets to both “Ovuone” and “Ivetu”.

He asked the court to declare that the properties listed in the MOU belong in their entirety to “Ovuone” being gifted jointly and several times to “Ovuone” in the lifetime of the late Chief Ibru.

Such properties include No. 1, Marine Road, Apapa, Lagos; 47, Marine Road, Apapa; 49, Marine Road, Apapa; 52, Marine Road, Apapa; 5,7,9 Emotan Road, Apapa; 3,5,7 Ladipo Oluwole, Apapa; Daska House; Blomfield Court; 33, Michael Ibru Boulevard; 6, Louis Solomon Close, Victoria Island, Lagos and 5/7, Queens Barracks Road, Lagos.

Others are No. 20, Queens Drive, Ikoyi, Lagos; 6, Kensington Park Gardens, London; Starcross Farm; Hillcrest Apartment; Zabadne Plot, Abuja; Maitama Plots, Abuja; Maroko Plots, Lagos; 7, Randle Close, Apapa, Lagos; all shares in Oceanic Bank; Oteri Holdings Limited’s shares in Minet Nigeria Limited; Oteri’s shares in Ibachem and the portion of Ibafon land occupied by Ibachem and Ovwian land.


The claimant is also seeking a declaration that the judgment delivered by Justice John Tsoho of the Federal High Court, Lagos on April 17, 2014 remains valid and subsisting, having not been set aside by any court of competent jurisdiction.

Oboden also asked for an order appointing himself, seventh defendant, Christiana, first defendant, Oskar and eighth defendant, Jero, as administrators of the Ibru estate and an order directing them to apply to the 16th defendant for the grant of letters of administration for the estate.


An order of the court appointing Messrs. PricewaterhouseCoopers Limited to conduct a forensic audit of the shareholdings and assets, whether real or personal, belonging to the estate of the late Ibru in Oteri Holdings and any other company in Nigeria or anywhere such may be located, discovered or found in the world and submit such report to the Registrar of the court within 90 days of the order and the cost of such exercise be paid by the administrators so appointed herein.


The claimant is seeking an order directing the administrators to divide the assets into 16 equal shares and that same be given to all the 16 surviving children of the late Ibru.


But in a counter-claim, eighth defendant Janet urged the court to declare that all matters pertaining to the estate be adjudicated in Nigeria as well as a declaration that she is entitled to a refund of all expenses, including the $48,000 incurred by her in defending the law suits of the second defendant.

Furthermore, she is seeking an order of the court directing the administrators of the estate of the late Ibru to refund to her, the expenses incurred in taking care of the late Ibru during the final year of his life.

    4. My concern when I see people fighting over their parent's properties is why they didn't take advantage when their parent was alive. For a man this rich i'm sure the children had an advantage. Best schools,great opportunies. Why didn't they better themselves. Again, are people just greedy? wanting to acquire more wealth. I'm sure they are all well to do but not just satisfied. I wonder what we teach our kids. I believe in being independent. He worked for his money go and work for us instead of fighting over another person's sweat.

    2. @uniq gem, you never see when siblings same mother and father dey fight over properties. I even see such happening in my family. My brother is a lazy taut and he is waiting patiently for my dad to die so he can lay his hands on some properties. I have been praying my dad sell his properties because he has given all of us equal opportunities. I am a graduate with a very good job but my brother has never been useful for once always dependent on popsie. Popsie is 73 and he is the one paying the school fees of his two kids and most of their expenses but when it's party time my brother go see money blow. SMH. He is 35 years, still lives in my dad's house and my dad is the one taking care of his wife and three kids.

    "Only those whose paternity are confirmed by DNA are entitled to an equal share of their Father's estate.

    Dunno why some "big men" behave like this. And they know that after their death,comes big confusion amongst the kids and they stil won't put their house and wil in order. I remember Abiola's own. Poor Kola had to deal with the whole messy affair. I felt soo bad for him.

    Dunno what is it that make naturally good-willed men behave in certain ways.

  9. Polygamy and its problems! In this case, its actually a case of greedy children because I have seen instances like this even among children from Monogamous marriages. When will children learn to work hard and stop waiting to inherit their parents wealth when they die?

  11. Stella......... iv seen many cases even with family members I know. 3kids, same mother and same father that they are carrying eachother to court.
    The first born and only girl is taking her brothers to court over their late mother's estate. With a school and so many properties involved.
    Just pray about your own family, when REAL money is involved you know people's real nature. You go shock Stella, things this woman is doing to her brother's.
    Bought a house in lekki for the mother, opposite her own property in the old woman's later years, she was sick then with a nurse etc. She bought the lekki property in her own children's name, not mama's name. Mama was old so signed so many stuff she cant remember.
    Now she died, this ladys kids have taken over the property that is supposed to be a family house.
    So many things she's done because her brother's are soft people, plus they are based outside naija.
    She's taken over all the businesses, giving her junior brothers stipends which theyv refused to collect and gave them the property in the village.
    The last will this woman did was a few months before she died, which was changed from the one she did in the 80's. They believed its all fake as she was very ill and lost her senses sef before she died.
    They are still in court, but they've even left her to do with the money as she pleases.
    Even the late FRA Williams, kids same mother. carrying themselves to court.
    When the money is serious money like them Ibru's money. Its bound to happen.
    Even soon those that are same mother as Obode can still fight him that they gave them property in Apapa, that the want the one in Island.
    Though having all your kids same mother is better, but you cant plan life.

    Will a man or woman disinherit their children whether biological or non biological ? Sensible people clearly put their house in order by writing legit statement ( a will) to name their heirs & heiresses. But here its a typical naija people things to put one's own family in disarray & stress all just because of money!!!
    And I'm none of those kids go get mind before to even aim high & do better than their parents.Some rich people's children carry plenty curses upon their head. No wonder people like Bill Gates are not living any money or cash for their children. They'd rather train them well, educate & give them the best opprtunities in life to go & get theirs if they want big time money!

    Me I'm not living any money for my children or grandkids. My money will go to trust fund set up for the education of my generations. No descendants of mine will lack in access to education or fundamental training.
    Not cash to dash anybody! If dem no get brain for book smart or street smart to hustle & find their own...then shikena!!!

    1. My dear, that's oyibo people for you. Here most of them keep their investment whether in cash or kind mostly to their grandchildren. The parents make sure that they going their children sound education.
      So this man knowing that one day one must answer the call of the nature couldn't draft a will. They should look well, it can't be so now.

  16. My cousins all from same parents lost their last brother. There is a bloody fight going on now for their late brother's money. Both physical and spiritual. It's not all bout polygamy. Like one poster mentioned, when 'real' money is involved that's when you know the 'real' nature of human beings.
