Husband Says He Went Home To Pick Up Something And Caught Wife With Lover

A mother of three has lost her 14-year-old marriage to adulterous behaviour as an Igando Customary Court in Lagos granted the request of her estranged husband to dissolve the union. 




The petitioner, Mr Dare Abiodun, a 40-year-old businessman, had approached the court for the dissolution of the union, citing the wife’s infidelity and threat to life. File photo… Delivering his judgment, the court’s President, Mr Adegboyega Omilola, said he was convinced that the couple could no longer live together as the petitioner insisted on divorce after several interventions.


 “The court has no choice than to dissolve the union in spite of the wife’s claim to still love her husband. “The court hereby pronounce the marriage between Dare Abiodun and Ajoke Abiodun dissolved today; both henceforth cease to be husband and wife,’’ Omilola ruled. 


The husband had told the court that he caught her wife with her lover in their bedroom. “I came home to pick something in the morning and I met my wife with her lover inside our room eating food bought from an eatery,” he said. Abiodun said that his wife had been threatening his life with some dangerous weapons. 


He added:“My wife is always threatening my life with dangerous weapons; she chased me with knife in our street to stab me. “She is a good fighter; her hobby is fighting as I have, on at least five occasions, bailed her at the police station. “She fight with friends, neighbours, even in the church and I had to leave that church for her because of this shameful acts.” The estranged wife, Ajoke, however, accused her ex-husband of being fetish and he killed a baby in her womb sometime ago. “He gave me `Suya’ to eat when I was eight months pregnant and the baby in my womb became restless, moving fast.


 “ I rushed to the hospital only for me to have a still-birth,” she said. The woman, who did not object to the dissolution of the marriage, also told the court:“I saw my brazier in my husband’s brief case and when I queried him, he said he wanted to take it to his church for prayers. “He also brought a handkerchief to the house and gave it to me to clean my private part and return to him but I refused. “He has been bringing home different types of soup and other liquids for me to drink which I also refused because I do not trust him. “Apart from his fetish nature, he has also turned me to a punching bag.’

    How fast can someone get a divorce in Nigeria?
    Someone told me 3 weeks is possible while some other people said you cannot get it in less than 6 months?
    Help a sister out

    1. The person who told you 3weeks lied. Depends on the type of marriage that was celebrated (customary or registry or in a licensed lace of worship) I'm not familiar with the proceedings in the customary court but I will tell you that if you had a registry marriage or the one celebrated ina licensed place of worship you will need to file a petition In a state high court which will require your husband the respondent to file an answer within 30days. If your husband is not opposed to it, he may file his answer and then both of you (with your lawyers of course) will draw up terms of settlement, sign same and file in court. On the next adjourned date, you adopt the terms and the court pronounces it it's judgment.
      But if your husband is pigheaded and decides to contest the petition, hmm. .. It can take years depending on the court. I always advice client not to be aggressive or scandalous in presenting their petitions. Makes it easier getting the other party to amenable to out of court settlement. All the best

    4. In that case, if you move fast, you can get the marriage dissolved in time for Christmas. But know the order will become absolute after 3months. Just file the petition and serve your husband. He answers within 30days. Then you draw up the terms and file. Your lawyer can take care of it. All the best
