popular Nollywood actor, Emeka Ike has informed a Lagos Island Customary Court that he had filed an application before a High Court restraining the lower court from hearing the divorce suit filed by his estranged wife, Emma.
Emma had sometime in 2015 approached the court to dissolve the 16 year union between her and the Nollywood actor on grounds of incessant battery.
Emeka had denied the allegation vehemently and begged the court not to separate them, saying “I still love my wife’’.
When the matter which was slated for judgment came up on Tuesday, Emeka’s lawyer, Mr Abdul Labi-Lawal informed the court that his client had filed a stay of proceedings before a High Court in Lagos.
The application marked FCMP/20054/16 had Emma and the Customary Court President, Mr Awos Awosola as the first and second defendants respectively. The application sought the High Court’s declaration that the Lagos Island Customary Court lacked requisite jurisdiction to entertain and determine the Ike’s divorce suit. The application noted that the marriage between the estranged couple was conducted in Enugu State under the Igbo customs and traditions.
Emeka also urged the High Court to declare that all the proceedings already conducted by the Customary Court in respect of couple’s marriage be rendered null and void. The Nollywood actor also applied for a perpetual injunction restraining the Customary Court’s President, Awosola, and any other person appointed in the capacity of entertaining and or continuing the proceedings in respect of the couple’s divorce suit. Labi-lawal, therefore, urged the court to stay proceedings on the suit pending the hearing and determination of the suit at the High Court.
Opposing the application, Emma’s lawyer, Mr Iheanyi Awa urged the court to discontinue the stay of application and deliver judgment. Awa, who said Emeka’s application was aimed at arresting the court’s judgment, informed the court that neither his client nor himself had been served with the application. “It is an attempt to arrest the judgment of the court, I am aware that the respondent wants to arrest the judgment which is to be delivered today.
“The stay of proceedings has been decided for a long time and court has ruled that it has jurisdiction to entertain the matter. “It is a ploy to frustrate my client, they just want to delay the judgment till another day. “The court should give its judgment and if they are not satisfied, they can appeal,” he said. After listening to the submissions of both parties, the court said; “In view of the submission of the respondent, the stay of proceedings is hereby granted, and the matter is hereby adjourned sine die.’’

If the court decides to stay proceedings, why not adjourn proceedings pending the ruling of the High Court where Emeka allegedly filed a motion as that is even one of the reliefs asked for?
ReplyDeleteThe president of the customary court ought to know that Emeka (the respondent) is merely applying delay tactics because it is painfully obvious. 1st, he challenged the court's jurisdiction during proceedings, to which the court overruled his application and ruled that it has jurisdiction and proceeded with the hearing. Now another application just before judgment is to be delivered?
It appears the facts are incomplete because if all Emeka and his wife did was a traditional marriage under the Igbo custom, the customary court has jurisdiction to hear and determine the petition, not the High court. It doesn't matter that the marriage rites took place at Enugu, the couple have lived over 10 years in Lagos. The High Court hears only divorce petitions where couples married according to the Matrimonial Causes Act, i.e, marriage at a Registry or a church wedding where the marriage register was signed and the couples were issued marriage certificates.
Does Emeka really think he can force a woman who is already fed up and has checked out emotionally and physically to return to him? His ego is clouding his analytical mind. If such a woman returns to him, his life is even in danger because she can kill him just to break free from his malevolent grasp. Since when has " I still love my wife" been justification for frustrating a legal process?
He is just being mean and unreasonable. His tactics are only going to make his wife loathe him the more. Do you know how irritating it is to be held back by someone you don't want in your life anymore? Instead of going under the radar to win her back by showing he is a changed man, he is busy being an irritant. The worst he can do is already what he is doing, stalling the process. If she's determined to go ahead with the divorce, she will. Even if it takes her 5 years.

What if as she left him and started praying in okotie's church and the revelation of the Lord comes to her that emeka is not her husband according to God's will, don't you know that God will definitely take her to where he wants her to be according to his will regardless of every circumstance in her surroundings? I also want to make a scenario which happens everyday. Eg. A woman uses charm to make a man she loves marry her because she wants that, but is that what God wants? And then the man marries her under that spell but she alone knows what she did to achieve that not the public. Then after several years with kids the man meets whom the Lord predestined for him and automatic his eyes are cleared and he says he is leaving his wife for that woman. The wife will first scream husband snatcher knowing in her heart how she got him, the public will join her to scream husband snatcher thinking from their human moral thinking of how marriage should be sacred without knowing the truth. At the end God always prevails because he searcheth the hearts and the deep things, but then some of us who join to curse out the other woman without knowledge might end up being partakers of 1st woman's evil.
