Ibinabo Fiberesima Spent 3Weeks In Jail And Was Granted N2M Bail

The embattled ex-beauty queen and Nollywood actress, Ibinabo Fiberesima, on Thursday got temporary relief, when the Court of Appeal in Lagos granted her bail pending the determination of her appeal at the Supreme Court following the five-year imprisonment slammed on her for manslaughter.



The appellate court, in a two-to-one split judgment, decided that Ibinabo’s application for bail had merit.
Justice Samuel Oseji, who read the lead judgment, granted her N2 million bail with two sureties in like sum.

The court said the two sureties must be resident in Lagos and must each swear to an affidavit of means.

Justice Oseji said he was inclined to exercise discretion in Ibinabo’s favour in view of her health and because there was no record that she had jumped bail in the past.

The judge said it would amount to injustice if after the Nollywood actress had been kept in prison and the Supreme Court later, after about three to four years, decides that the five-year jail term imposed on her should be set aside.
Justice Sidi Bage, who presided over the proceedings, aligned himself with the lead judgment but the third member of the panel, Justice Y.B. Nimpar, dissented.

Justice Nimpar said the ill health, as reason upon which Ibinabo anchored her application for bail was untenable.
The judge noted that there was no record before the court that Ibinabo had suffered any complication since February when she underwent surgery for breast cancer and April when she brought her application for bail.

Besides, Justice Nimpar said there are adequate medical facilities in the prison to cater for her health needs, adding that the prison hospital could also give her referral for consultancy in the event that she has any condition that could not be taken care of by the prison hospital.
“The surgery was uneventful. The surgery was done in February, now we are here in April and there is no complication.
“The applicant is already convicted and presumption of innocence is no longer available.
I personally will not exercise discretion in favour of the applicant,” Justice Nimpar held.


In support of Ibinabo’s bail application filed through her lawyer, Nnaemeka Amaechina, one Victor Eden had deposed to a six-paragraph affidavit stating that Ibinabo recently had a surgical operation for breast cancer.

Eden said in the affidavit that Ibinabo was afraid that her life might be endangered if kept in prison custody.

He had urged the court to grant her bail in the interest of justice.
He said it would best serve the interest of justice to release Ibinabo on bail while the Supreme Court’s decision in her case was being awaited.

Surprisingly, the Lagos State Government, which is prosecuting her, did not oppose the application but asked the court to use its discretion.

The state, represented by Mrs. Rotimi Odutola, held that the concern of the state was the pursuit of the appeal filed by the convict.
She said the basis of the appeal was not on whether Ibinabo was guilty or not, adding that the actress did not dispute her conviction but only appealed the sentence.

Justice Deborah Oluwayemi of the state High Court had in 2009 convicted Ibinabo for manslaughter, submitting that her reckless driving was responsible for an auto crash, which claimed the life of one Dr. Giwa Suraj on the Lekki-Epe expressway.

While sentencing Ibinabo to five years imprisonment, Justice Oluwayemi overruled the decision of the state Magistrates’ Court which had earlier ordered her to pay N100,000 for the offence.

The verdict of the Magistrates’ Court had angered the Lagos State Government, which expressed serious outrage and decided to appeal at the state High Court.

Dissatisfied with Justice Oluwayemi’s verdict, the convict approached the Court of Appeal to nullify the verdict but the court also affirmed it, compelling the embattled Nollywood actress to approach the Supreme Court. The matter is pending before the court.

      It is quite unfortunate that Nigerians bring in so much sentiments into everything. If she was not driving under the influence, all these wouldn't have happened.
      She has been convicted of manslaughter, let her do the time. Nigerians should start holding people accountable for the things they have done, you all are here crying pity for her yet you sit in your hot houses without petrol, light and heat waiting for Change to come, yet you keep drumming for corruption and standing on the way of Justice.

      In summary, she should return to her house pending when the Supreme Court reviews the case and decides to dismiss the jail term. So in essence this case is closed. All this grammar na just formality.

      The first returned from a burial, he didn't drink @ all and was very sober. He hit a child who was pursuing his kid brother on the express way... in a very hostile community. he RAN to a POLICE STATION and REPORTED himself. Two officers followed him. The child was rushed to d hospital, and two days later transferred to calabar; he was still in coma, but died on d 3rd day after he came out of coma.
      His parents cried... money exchanged hands, full burial was organized, many visits and pleas... he was forgiven. that was two years ago.
      He still hasn't recovered from the trauma.

      A family friend's son, very wild and silly, decided to show off his James Bond skills, hit a POLICE OFFICER, and ran away. Ran home and hid in the ceiling. It was close to an army barracks, so some soldiers chased him. Went to their house and removed him from the ceiling where he was hiding.
      The officer died after his fellow officers close by took him to a hospital.
      We realized the officer was from our hometown.
      His parents cried and begged, buried d man, and took over paying the kids fees. The family dropped the case (even when the police officers didn't want to).
      The boy became humble when he saw prison staring him in d face, and was subsequently sent out of the country.
      It boils down to how you present yourself during and the incident. Where was her family? Did she beg the Giwa's with elders? Cry, roll, mourn, show remorse? This thing has lingered for too long, and I dare say it's her fault it turned out this way.
      May God help her through this.
      Hope the Giwa's find it in their heart to let go...it's difficult, but it's necessary.

In the two cases you mentioned, look at the attempts that were made to pacify the family of the deceased. It will not bring back the dead but it will atleast bridge a hollow gap.     I avnt been dere but I have heard stories.
    Its very possible they release her at night and she returns the following day to sit behind the counter.

    Nigerian prisons is not a good place to be... my pop's laundry man got into trouble last yr, he said to reduce d population in the prison they would randomly pick prisoners pretending as thou dey had somtin to tell dem, take dem to an unknown place to shoot dem. And dat whateva standing position u take, u wld keep till u leave, or u pray som1 slumps n dies.
    Poor guy had to treat himself and stay indoors for like 2wks before he could come out.

    Am happy she was granted bail, and to Giwas am sorry...its well.

What if the man was just an ordinary person, she would have gotten away with it. Yet if people that were half dead die in hospital, you will demand the Doctors head. Well, let her battle with Lagos state.

Ibinabo dis, Ibinabo that, why did she drink when she knows she's going behind the wheels. When I was in Nigeria, I have met her severally in occasions DRUNK. On one, she was almost removing her clothes to pee in the middle of the hall where all the guests were entertained.
      Same with hilda Dokubo back then, always getting drunk.
      She made a wife widowed, children fatherless, mother without a son and sblings without a brother. In a situation that could have been 100% avoided. It is better to keep quiet sometimes.

A life was lost and people are talking about her not doing it intentionally. Many people kill others unintentionally and they get jailed. Cars knock people down on the road and kill them. Was it intentional? Nope it was manslaughter! They take them to jail and they do their time. People cuss the driver. Y should i binabos case be different. This family lost a loved one and anyone that has ever lost a loved one knows that it matters how the person died. You want to know if the person suffered or if the person didn't. Knowing she fled the seen and the man was probably still alive then must have been so painful for this family. People are not thinking about that. They just talk about ibinabo and her kids like the dead man didn't have kids or responsibilities. Worst thing is she was not remorseful as reported. Guess if she was, the thing won't have gone the way it did and might have never reached the courts in the first place. A friend of mine almost died on Easter Sunday. He was knocked down on the road by a speeding vehicle. He was standing at the bus stop with his family friend. The woman died at Luth. My friend ended up with bones broken everywhere. This dead woman left behind a 3 year old son and a husband. So the driver of that car that rammed into them where they were at the bus stop should go free??? Driver was high. Obviously he never meant to kill anyone but he did. So he should go free???? People should use their brains on this blog. People like money makers wife who was spewing rubbish under my comment last time

  20. Abeg I don tire for ibinabo case. If dem gv her 5yrs good, if de grant her bail fine. Someone DAT hv served 13yrs, will be leaving today. I thank God for her life, ibinabo no get 10heads. She committed worst crime Dan ds lady dt just finished her 13yrs jail term. She gave birth in prison, now they are yaning her story that her baby is no whr to be found
