Actress Ibinabo Fiberesima Bail Application Suffers Setback...

Actress and former beauty queen Ibinabo Fiberesima, who is currently serving a five-year jail term, was denied bail by the Court of Appeal in Lagos on Thursday.



The three-man panel of judges, headed by Justice U.I. Ndukwe-Anyanwu, ruled that the application was incomplete, as the appellant failed to attach to her application copies of the judgment affirming the five-year jail sentence imposed on her by a Lagos High Court.

Presiding Justice Ndukwe-Anyanwu said the only option left was to strike out the application and adjourn it to a further date for a hearing.

Consequently, Nnaemeka Amaechina, Ms. Fiberesima's counsel, asked for an adjournment to enable him to correct the bail application. The court subsequently adjourned the matter to April 7.

Meanwhile, Ms. Fiberesima asked the Supreme Court to set aside the judgement of the lower court that was affirmed by the appellate court.

In her notice of appeal, she stated that the Court of Appeal erred when it affirmed the alteration by the High Court of Lagos State by setting aside the option of a N100,000 fine and substituting it with a prison term of five years.
The appellant further stated that the Court of Appeal erred when it affirmed the interference by the High Court with the exercise of discretion by the Magistrate's Court. 

Ms. Fiberesima added that the judgment of the Court of Appeal was unreasonable and could not be supported, with regard to the evidence presented before the court.

In a six-paragraph affidavit of urgency deposed to by one Victor Eden, the deponent stated that Ms. Fiberesima is currently recovering from breast tumor-removal surgery and requires medical attention.

“Her wound has not fully healed and as such she is afraid that her continued stay in prison may endanger her life, as she will not have access to special medical attention," he stated.

The deponent stated further that it would be in the interest of justice and for her health to admit Ms. Fiberesima to bail pending the hearing and determination of her appeal to the Supreme Court.

The actress was handed a five-year prison sentence by Justice Deborah Oluwayemi for reckless driving, which caused the death of one Dr. Giwa Suraj in an auto accident along the Lekki-Epe Expressway in Lagos. Dissatisfied, Ms. Fiberesima, in her amended appellant brief filed by Mr. Amaechina, urged the court to set aside the five-year sentence and restore the decision of the Magistrate's Court.


The appellate court dismissed the actress’ appeal in its judgement delivered on February 11 and affirmed the decision of the Lagos High Court.

It's only 5 years, it will be over soon. The man you killed will never come again, that should be enough reason for you to do your time quietly.

      It was a freaking accident for crying out loud. Accidents happen..she didn't step out that night with the intention of killing the doctor.

      I've been in an accident before where someone unfortunately died..no amount of therapy sessions could take away the thought of me killing someone. Its the worst thing that could happen to anybody. I resort to drinking and clubbing just to forget,but no way. At a point,I was put in a psychiatric home.
      Its been 20 years,but the memory is still fresh.
      This will hunt her for life..forget the fronting. As it could be her own way of trying to forget.
      I know. I've been there for 20 years and counting. Its pure torture

In Germany where you live, would you be given that kind of option if you killed someone due to reckless driving? You know the German government will even imprison you for more than five years and also seize your driver's license after serving your prison term. Don't try to be cheeky with this judgment. Ibinabo committed murder: whether intentional or not. One way or the order, there will be a court case and a punishment for such offence. She was at the recent AWARDS publicly displaying herself to the whole world, and also hard the strength to attack those who criticized her dress at the award....but prison, HMM, I JUST HAD SURGERY. Was she not supposed to remain at home for her surgery to heal before coming out to the public at the award?

    Just because she is someone you like or have a close relationship with does not mean the court should not pass a judgement on her. A life was lost because of your recklessness and you are busy running from pillar to post for people to save you from jail time not death by hanging o. This is why you are getting no empathy, your posts are too selfish. You need to accept the sentencing n apologize to the family for your recklessness.   54. The problem with Ibinabo is her lack of humility and a repentant heart, has she ever publicly uttered an heartfelt apology or shown any remorse for the incident of that fateful night? Has she started a fund for victims of drunk drivers, or one for the children of the deceased victim? No, just me me me, and even still today me me me. Not one interview, public service announcement, page in the newspaper to speak on what she did and the pain she caused the families by showing remorse and telling Nigerians the dangers of living recklessly and the need to always be sober when operating a vehicle.

    She didn't even try to serve one year of her sentence and then launch an appeal, even just one, she does not want to serve anytime at all for taking a person's life. Imagine, she did a hit and run, an extremely serious crime, and expect to get off scot free, one man died and another is permanently maimed, but she should be able to live in full and complete freedom. This woman would spit in the face of God if she got the chance, she don't give anything about anyone else. Ibinabo, if you refuse to serve your sentence then your children or grandchildren will one day have to serve it for you, are you willing to put a generational curse on your lineage because of pride? Pay your debt and release bad karma from yourself and clear your children's future. You think the tears of a widow and fatherless children are not seen and heard by God? and it is not just only the man who died that you hurt, two had to be hospitalized, and one is permanently maimed; my dear, those are the tears of three families crying to God, He heard their cries and granted them justice, now you are flying in the face of justice instead of walking in humility.
