BREAKING: Wike Loses At Supreme Court


The sacked Governor of Rivers State, Nyesom Wike, has lost his bid to nullify the sitting of the Rivers State Governorship Election Petitions Tribunal in Abuja.



The Supreme Court on Tuesday morning threw out the bid by Wike to declare the sitting of the Tribunal in Abuja as being against the law.

The court said the President of the Court of Appeal acted in line with the ‎law.

It said the relocation of the tribunal to Abuja was to safeguard the lives of the tribunal chairman and other members.

The court affirmed the judgement of the Court of Appeal, which had earlier okayed the decision of the Tribunal to assume jurisdiction.

  10. Stella is it that you are so pro Amaechi that you don't consider what you write? This is not the last chance. This case is different from the Saturday one - in this one, he was challenging why the case will be moved from Rivers state to Abuja while the other one was filed by APC and in losing that, he has the options of appealing to higher courts- high court of appeal and supreme Court. It's when he has exhausted both options and lost that you can say he has failed. In any case even then, there is still re-election.

    2. And if the appeal upholds the ruling of the Tribunal, he can take to Supreme court and if Supreme court upholds the appeal then there will be re-election 90 days after that. Meanwhile he is still the Governor until the outcome of the the re-run and believe me or not he has a huge chance of winning.

  26. You are running before you can walk properly stella. Take it easy. Wike is still Governor of rivers state. No matter what buhari does. Let him exhaust all appeals. He will still be ruling until his appeal has gone from court of appeal then finally supreme court. Which has the final say. Tribunal court is just the first court of instance in this matter. He will appeal. And it may take months or years. And until the supreme court gives the judgement and upholds the decisions of the lower court section 143(2) of the constitution makes Wike to still be governor. So it is not that easy you apc witches. And if need be rivers people will still vote him in. So screw you fuck face

  31. In most cases, you're balanced but in this particular Wike vs Amaechi thing, your biased side has reared it's head. You like ameachi sha. Lol. You're in such a haste aand you're not even checking details.

    -This is a pending application before the supreme Court to ascertain whether the tribunal erred to sit in Abuja instead of rivers. Venue and Jurisdiction. Honestly, hardly does venue ever nullify decisions. Hardly ever. So, it's natural that he'd lose this appeal. Would have stood better if the case was on going. Its concluded, properly constituted and judgement passed. So, the supreme Court can't quash it on something that trivial.
    His lawyer is a SAN, he won't pass off any chance at all too be heard.
    - however, the main appeal they are preparing will be to challange the judgement itself. Whether the problem with electronic card reader can nullify an election. Whether the tribunal had any basis to convincingly believe that the entire election was marred with violence, whether all the state should have been nullified based on the evidence, whether the tribunal erred by not following the decision in Agbaje vs Ambode and other things.

    However, on an aside. The govt should handle this issue very carefully. Its potentially inflammatory. they might be bloodshed if there is any reason at all to believe that the federal govt is doing anything to sabotage pdp and Wike. Rivers politics is very volatile. Its a very different specie of politics.
    Because, this issue of changing the judge of the tribunal midway, and saying the man was compromised is something. Raises eye brows. The many strange things.

    Let's see the next course of action.

Buhari should let Rivers state be o..for peace to reign..there will more bloodshed o..as I'm typing this now,there are up to 50 youths in my compound having a very silent meeting.i live in Chinda's (the guy that Chidi Lloyd broke his head in HOA) compound..there has been series of meeting with youths since Saturday..I'm leaving Port Harcourt this week..Buhari leave Rivers state alone..APC for peace to reign,accept your defeat in good faith.

    2. Well written, BonaParte NN. I wouldn't want to delve copiously into the matter since it's still sub judice but welcome to the art of prosecutorial acrobatics which has been bested by most of the finest legal minds. 

      It's obvious that the issue of jurisdiction raised by Wike's legal team is merely to stall the execution of the tribunal's ruling because instead of appealing in piecemeal, why not add the other grounds of appeal to the issue of jurisdiction so the Supreme Court can give a final ruling on the matter at a whole?‎

      It's trite in our legal system that jurisdiction is the lifeline of any proceeding and can be raised at any stage. So no matter how elegantly and brilliantly conducted any court proceeding is or how erudite the judgment arising from it is, once it has been established that the court( or tribunal in this case) lacks the jurisdiction to hear and determine the matter, the whole trial becomes a nullity‎. Of course the locus classicus, Madukolu V. Nkemdilim, says it all.

      Assuming the Supreme Court ruled that the tribunal lacked the territorial Jurisdiction, that automatically renders the sack of Wike null and void so he can remain on the seat of power as the Governor while tackling other legal issues that may arise. However, until the judgment of the tribunal has been set aside by a superior court, its judgment stands and Wike remains sacked. Wike can't remain the governor pending further appeal because that amounts to contempt of court. For those big on labels and name tags, the appropriate title is "Ex-Governor" till re-run of the elections due within the next 90 days.‎

      @Anon: I believe the SAN didn't put the other grounds of appeal through to the supreme Court as a tactic. The order that the tribunal be held in Abuja was made by the court of appeal. So, appeal on that matter should go to the supreme Court. So this was a grand opportunity for them to get final judgement. But it failed.

      Then they have to take the route of tribunal to court of appeal to supreme Court. Remember where the appeal for governorship lies. They couldn't have jumped the gun by including extraneous prayers, I believe. And the appeal will carry a stay-of-execution order pending when it's resolved. That's why some governors sit for 1year or 6months and their matter is in court.
      Dakuku was wise not to ask for a declaration but a rerun which he was in his rights to. Cos honestly, his votes ratio was very low.

      Anyways, lets see how it goes. I have d gut feeling that Wike may get away with this. Unless they set him up and disqualify him or EFCC does something. Let them just not shed blood while at it.

I would have agreed with your allusion if it were a case of Wike vs Ameachi for the seat.. but Ameachi scaled thru his federal ministerial screening so there's no contention again as such. Well, that's what I want to believe.
      However, I was a bit confused when someone up there said Wike would continue to be governor until his appeal. Which I think violates the ruling of the court that sacked him. Been trying to check what his situation says and what becomes of the Riverians until the supreme court decides. This will be an interesting one ooo. Lol

My problem is that all these criminal governors who are beneficiaries of rigging(a criminal offence) and by extension assesories before with and after the fact of rigging go away without any punishment and returning of emoluments received while the criminal acts lasted. Instead they use their cronies to now legally rig themselves back to office. Our greatest problem in this country that has made the situation the way it is is not corruption per say but lact of punishment to those that foul the land. For a start let these ppl who perpetrate electoral violence and rigging be jailed and you see ppl refraining from such. What is the object of criminal punishment, btw

    The appeal is based on d relocation of the tribunal sitting from the State to Abuja.
    His right of appeal on d substantive judgment of the tribunal nullifying his election has not been exhausted by his legal team. I guess they are on it and soon d SC will hear the Appeal.
    Meanwhile!, they can just go and do re-run jare make all dese noise go down joor.
