Lawyer Sues Buhari Over Non-inclusion Of Southeast In Appointments

The hue and cry over President Muhammadu Buhari’s appointments so far has taken a fresh dimension with a lawyer asking a Federal High Court to order the President to nullify the appointments.





The lawyer, Marcel Dim-Udebuani, in suit no FHC/ABJ/CS/732/2015, before the Federal High Court,Abuja, accused Buhari of allegedly breaching Nigeria’s federal character principle in his appointment of persons into key positions under his administration.

Dim-Udebuani joined the Chairman of the Federal Character Commission as the co-defendant.

He anchored his suit on the grounds “that the Federal Republic of Nigeria is a country for all the citizens, South-East inclusive.”

The lawyer hails from Nnewi North Local Government Area of Anambra State.

He contended that the 25 appointments made so far by the President were in breach of the spirit of federal character enshrined in section 14 (3) of 1999 Constitution of Federal Republic of Nigeria.

The President's last set of appointments announced last week has drawn strong criticism from many Nigerians, who accused the President of appointing mainly people from the Northern part of the country.

Buhari is from Katsina State in the North-West geo-political zone of the country.

Buhari had on August 27 approved the appointment of Babachir David Lawal from Adamawa State as the Secretary to the Government of the Federation.

He also named Mr. Abba Kyari from Borno state as his Chief of Staff.

Other appointments approved by the President included those of Col. Hameed Ibrahim Ali (retd.) as the new Comptroller-General, Nigerian Customs Service; Mr. Kure Martin Abeshi, Comptroller-General, Nigerian Immigration Service; Senator Ita Enang, Senior Special Assistant on National Assembly Matters (Senate); and Suleiman Kawu as SSA on National Assembly Matters (House of Representatives).

Both Ali and Kawu are from Kano State and Abeshi is from Nasarawa. Enang from Akwa Ibom State is the only southerner among the new appointees.

So far, no person from the South-East zone has been appointed into any position by the Buhari administration.

The plaintiff in the fresh suit prayed the court to reverse all the appointments the President had made so far.

Part of the questions he raised before the court include, “whether the total of the 25 appointments made so far by the 1st defendant (Buhari) is not against the spirit of Section 14 (3) of 1999 Constitution of Federal Republic of Nigeria.

“Whether the exclusion of South-East geo-political zone in the 25 appointments made so far by the 1st defendant is unconstitutional and divisive among others.”

The lawyer is therefore asking the court for an order compelling the Buhari “to reverse the appointments so far made to observe and comply with the principle of Federal Character as enshrined in the Constitution of the Federal Republic of Nigeria 1999 (as amended).”

He argued that it would be “in the best interest of justice and promotion of rule of law that the alleged lopsided appointments should be discouraged by granting all the prayers before the court”.

No date has been fixed for the hearing.

    4. He's chasing after the wind because this will lead to nowhere. The constitution said nothing about zoning or considering regions when making appointments. I have the 1999 constitution, so I know What I'm saying.

      Fed character is a principle and not a law in nigeria. Also, ministers are to be appointed from each state, all the appointments made so far are at the exclusive discretion of the president and as such he can appoint whomever he deems fit

  6. Wait for what? Which other major appointment is left? You'll see that he may not even follow the Federal Character principle in appointing ministers. My only problem is that the guy is just wasting his time cos no judge in Nigeria can rule against Buhari with the situation of things now. Everyone is struggling to be on his good side. I weep for the south. This is modern day slavery

  12. I have decided to join the crowd here and watch Buhari government as it unfold. This government would be judged on its performances. And I will always be ready with my criticism when ever there is need. I could always re-visit the issue of federal appointments if need be.

    But until then, this man's effort is just a waste of time, energy & resources. He's going on a wild goose chase!

    I don't know why some people don't use sense even when doing the right thing.
    It's not like the constitution compels Buhari to make the appointments within a specified time frame.

  15. My problem with Buhari is with his oil projects. Yesterday, there was a delegation of Niger Delta CDC to discuss how our oil would be channel through under ground pipe to Katsina State, in order to curb gas flaring and
    Oil theft.

    My major concern is this, why is NNPC offering to pay compensation to the communities???
    I hope the Niger Delta is not being deceived into selling their birth right.
    Is this the only way to curb gas flaring???

These days people are so self fish that when they get appointed, they forget their old friends and some would not even do anything to help extended family. Abegi, make we leave the man alone. That is the way to do it. GEJ surrounded himself with Hausa, Yoruba. How many ijaws served in the last administration? The entire Kolokumas were sidelined. Dieziani is from the Yenagoa area. Who else did Jonathan appoint from the main Ijaw area. Answer is zero. None. Please, PMB remember all your brothers they will never mislead you. GEJ was misled by the Hausas he surrounded himself with and he was not smart enough to realize that. I heard today that even the road to Federal University Otouke was not completed. What a failure.   21. For those saying that the vital positions av been given to the north , I want them to also recall that we call Jonathan a good man yet he failed. He failed because of the people he surrounded himself with. People that keep lying to him. People that kept telling him that he was on the right track while he was straying away. Those people were the people Jonathan trusted yet they failed him. If president Buhari will make a significant difference by surrounding himself with his own people that will not betray him so be it. All I want is the progress of this country. Cos outside this country am a Nigerian nobody cares abt my state or tribe. Change is all I want and change I must get!
