Police Say 14 Years Old Nigeria Child Bride Confessed To Killing Husband

A packed Nigerian court heard testimony on Monday
that a 14-year-old girl admitted to killing her 35-year-old husband with
rat poison, and signed a police confession with a thumbprint because she
cannot write.

Wasila Tasi’u, from a poor and deeply conservative Muslim family, has been
charged with murdering her husband Umar Sani days after their marriage in
northern Kano state.

Because she did not understand English, homicide investigator Abdullahi
Adamu translated her statement from the Hausa language dominant in the
region and gave her the document to sign.

She could not write her name, so “she had to use a thumbprint,” he told
the court during his testimony on the last day of the prosecution’s case.
The state’s lawyers, who are seeking the death penalty, also called to the
stand Tasi’u’s “co-wife”, a term referring to the woman — identified as
Ramatu — whom the deceased farmer had married previously in a region
where polygamy is widespread.

Ramatu said she got along well with Tasi’u and that the two had prepared
the food together on April 5, the day Sani died.
She testified that because it was Tasi’u’s turn to share a bed with Sani,
Tasi’u was also entitled to serve him his meal.
“After putting the food in the dish I didn’t see anybody put anything in
it,” Ramatu said.

She told the court she saw her husband sometime later being helped back to
the house by a neighbour, unable to walk and foaming at the mouth.
As she spoke the court was overflowing, with people peering in through the
open windows and a crowd so large it spilled out of the gallery door.
The case has sparked outrage among human rights activists who say Nigeria
should be treating Tasi’u as a victim, noting the possibility that she was
raped by the man she married.

But others in the region, including relatives of the defendant and the
deceased, have rejected the notion that Tasi’u was forced into marriage.
They have said that 14 is a common age to marry in the deeply impoverished
region and that Tasi’u chose Sani from among many suitors.
A motion by defence lawyers to have the case moved to juvenile court was
rejected, despite claims by human rights lawyers that she is too young to
stand trial for murder in a high court.

Further complicating the case is the role of sharia (Islamic law) in
northern Nigeria, which allows children to marry according to some
interpretations.
While sharia is technically in force in Kano, law enforcement officials
have no guidelines concerning how it should be balanced with the secular
criminal codes, creating a complex legal hybrid system.

According to Human Rights Watch, Nigeria is not known to have executed a
juvenile offender since 1997, when the country was ruled by military
dictator Sani Abacha.

The trial has been adjourned until February 16....culled

So I ask, is Sharia law now a federal law in Nigeria or where my teachers wrong?

    4. Anon 11:48. You are absolutely correct. In this case it is not a federal law and cannot be treated or tried as such. It all depends on the law in the state in which the crime was committed. In this instance it would have been more appropriate if she killed him in self defence. Say she was being raped or battered. Now the self defense here is still circumstantial...and a bit watery.

Bearing in mind that she premeditated murder by putting poison in his food. Therefore makes her a bit liable but cannot be tried as an adult as was stated.

The circumstances therefore is that she was under duress and felt she was caged. Now her lawyer will have to prove that the general atmosphere for her in that house portended danger, hence the crime. Or that she was emotionally deluded, so as to get a lesser charge of manslaughter as opposed to murder.

But honestly it would be tough to prove that she was living there under duress because of their culture. They make a general acceptance of it without consideration for the actual "victim" who was married away against her wish.

Unfortunately and irrespective of the sensitivity of her situation vis-a-vis "child marriage", she would be getting a sentence if the prosecutor insists on premeditated murder and that she wasn't endangered in her husband's house as being there is their culture and tradition. If the federal government wades in she may be sentenced to a juvenile delinquent correctional facility instead of jail, because sharia is not a federal law as of today.
So rarely, it varies, as with what the admissible evidence in court may admit. I feel sorry for her because she's the actual victim. If human rights activists take serious her case she may walk free. Pray tell.

    Ah ah!
Instead of her useless parents to send her to school to at least learn how to read and write, they married her off to a man almost triple her age.

Her husband got served and I don't pity him.
    He should rot in hell.

    1. Can u imagine. The irony of it is that whether they set her free or not they've destroyed her childhood already. In that she will be stigmatized along her family for killing that man. Albeit, even banished from that village. So she'll have to relocate, perhaps abroad where she may become an activist herself and a hero for her experience at this tender age.

A lot of them are in the U.S, making good their experience by writing books and giving lectures. Same as with those who sought refuge abroad after fleeing the female genital mutilation ordeal. She will grow up to be a wise woman with a lot to offer females who'll face same as her.

I see no reasons why a juvenile, a minor is being prosecuted within this confines.

The parents of the child are not making the case any better, well guess their culture is also deeply an influence.

  22. I feel so sorry for this poor girl. Given out to marriage against her will at such tender age without education and no knowledge about what marriage entails. It's just so sad that the Northerners keep practising this crazy culture. I don't blame the girl, she did it out of naivety but murder should have never been an option. I just hope she doesn't get the death penalty.

I hope they treat this case as a juvenile one cos some yeye Moslems men in the system of marrying kids will clamour for her head.

    2. Exactly. That's the point; children should be doing what children do and not play wives but the point is she was married under the law - Sharia or whatever law that recognised her at getting married at such a tender age. I sincerely hope for the sake of natural justice & humanity this child bride escapes capital punishment but letting her go scot free? I doubt!

      Delete
    3. That's my fear. I doubt that they will let her free. But, if this matter gains international recognition like the bring back our girl saga, with all and sundry following up on her case like that Sudanese lady that was to die but was later freed and given refuge in the UK abi U.S, then she'll be fine. Perhaps we should make her a hash tag too.

This girl is the victim in all of this. She's still a minor and should be sent to a juvenile correctional facility.

It's also possible she's innocent of this crime and didn't fully understand what she was doing when she put her thumbprint to the confessional statement.

  59. The news is skewed & deliberately 'disbalanced'. The law under which the lady in question is being tried is Penal code (applicable in all Northern states) which is different in texture from Criminal code (applicable in Southern Nigeria).

The statement referred in this case is confessional statement which, if voluntary, is admissible against d maker.

The point d news should av made is that the trial is unfair and that the rights of the accused has been infringed.

The age of the accused in this case has been overtaken by her marital status since any female in Nigeria, once married , is regarded an adult (recall d brouhaha this generated sometime last year in d senate?).

Thus if of age, she can be tried as an adult and appropriately sentenced unless there's pardon from d Governor.

The Justice in this case is in 3 phases . Justice to the dead, the accused & to d society.

A child who has been married off to a grown man surely is not emotionally and physically ready for the complexities of a sexual relationship. They need to let this child off the hook and tackle the fundamental issue of child marriage.
