Uganda HIV Nurse Rosemary Namubiru Jailed By Kampala Court



A Ugandan court has sentenced a nurse to three years in prison for negligence over the potential infection of a two-year-old boy with HIV.



Rosemary Namubiru, who is HIV-positive, was criminally negligent by using an intravenous needle, that she had accidentally pricked her finger with, on the child, the court ruled.
The child was not infected and HIV/Aids activists condemned the trial.
The case was keenly watched and some papers dubbed her the "killer nurse".
The boy's father, Daniel Mushabe, welcomed the ruling, saying he hoped the case would spur President Yoweri Museveni to sign into law a bill which criminalises the transmission of HIV.
The bill - already approved by parliament - says anyone who wilfully passes on HIV could face a fine of $1,900 (£1,130), a 10-year jail term or both.
Namubiru's five-month trial has been closely followed in Uganda, reports the BBC's Patience Atuhaire from the capital, Kampala.
Many members of the public were condemned the nurse, while HIV/Aids activists defended the 64-year-old, our reporter says.

Handing down sentence in a packed court room, chief magistrate Olive Kazaarwe said Namubiru lacked remorse for her actions.



Namubiru, a paediatric nurse with 30 years' experience, had maintained her innocence during the trial, and the boy was not infected with the virus.


Her lawyer David Kabanda said he was unhappy with the ruling, and was considering what to do next.
Namubiru said she had decided to administer intra-venous fluids through the boy's arm, but had difficulty finding a vein in which she could insert the needle.
It was then that she accidentally hurt her finger, but had no intention of passing the virus to the boy, she said.


Welcoming the ruling, Mr Mushabe said he hoped doctors and nurses will now "think twice" in future when treating patients.


"It is extremely hard to feel happiness in such circumstances without really getting to the bottom of the matter and finding out why Namubiru, without any provocation, went out of her way to infect our child," he said.

HIV/Aids activists said the nurse had not acted maliciously, and her life had been ruined.
The public anger towards her show the stigma people with HIV/Aids still face, they said.
Uganda won worldwide praise for its vigorous campaign against HIV/Aids, which helped reduce the prevalence of the virus - which reached 30% of the population in the 1990s - to single-digit figures.

    After pricking herself accidentally ,did she go ahead to use the same needle??

      As for this nurse, her action is criminal and her sentence is well deserved. Even if she didnt have HIV, why should a nurse prick herself first and then go on to use the same needle on a patient? Moreso when she knew she had an infectious virus.     6. This isn't discrimination. She has d virus n shouldn't b in a department where she will b handling needles, pins razor etc. That is not 2 say she can't work. She can b in pharmacy, reception, can b taking vital signs n many more. Btw, she accidentally pricked herself n didn't care 2 change d pin? Isn't dat carelessness on her path? @ pinkshell wat is she suing 4? Who is she suing? HiV/AIDS is still a deadly disease n d need 2 b careful wit sharp objects around its carrier cannot b over emphasised.

  16. stella you are just so ignorant its amazing.....fools will just follow u and be asking stupid questions....they can work so far they wear gloves to perform this kind of function..all medical personnel are supposed to wear it too....i wonder if the parents would have made any noise if it was their son who was HIV positive..they cannot be discriminated upon cos of the disease....stupid mamie, except fluid is exchanged you do not contact HIV so why cant they operate if they have the right protective gear?

  17. anonymous 9.16 am youareso ignorant backward and a bloody liar....in developed countries they have direct contact with patients but adequately wearing the right protection...in this case when she accidentaly hurt her finger she should have discontinued the procedure.....howbeit the case, it doesn't show any evidence there was any premeditated intention to infect the boy......

    1. what are u talking abt? im a registered nurse n I live in Italy. We go for medical check up every 6 months by law. when someone is found with d virus he or she is given 2 options, either she agrees that his/her colleagues are told abt her medical condition or she quits. if she acceptes she will be placed where she will not be allowed d use of sharp objects becos of mistakes like this. will someone come to d hospital to get cured n end up leaving with a sickness that has no cure?

  21. Sending her to jail is too much in my opinion, the most they could have done is revoke her licence to practice nursing and fine her, And it says the boy is not infected (which means he was given post exposure prophylaxis), so that was a rather harsh punishment.

Am a nurse in one of d teaching hospitals in Nigeria.i keep saying it everyday.Doctors and nurses she be screened for HIV every 3 months.Anybody dat test positive will be transferred 2 a department where he wnt be in direct contact wit patients. I see things everyday.Health workers infect patients deliberately or non deliberately everyday in d hosp. If u go 2 hosp plsss be careful now. Make sure whatever dey r giving 2 u is done in ur prescence. Cases in theatres is story 4 another day.Negligence on d increase.Chizzy

Am pregnant o I went for immunisation don't knw d name for it sha when I got there d nurse just brought out a needle with d drug already in it from a carton I was surprise cos usually d always open d needle infront of me i asked d nurse to use a new needle she said she just opened it I told her that I didn't see when she opened it she got angry n started talking I just stood up n ask another nurse to come n giv me d injection d new nurse told me not to be angry she then brought out a new needle gave me d injection n I left. . Naso d nurse for giv me unknown disease o. Pls wen u go for injection make sure u see when d needle is being opened.

  26. As a health worker, I have seen patients infect health workers too..yeah! Sometimes u help a patient with someting and he or she had a needle in the bag and you get pricked by it...it happens here in Nigeria and the health workers live with it........Hiv is not written on the face..that doctor u run to at the slightest instance may have it, the nurse that cares for u may have it.......safety measures should be taken to avoid transmission.....in a lot of countries, heakth workers with HIV work with non infected patients....Nigeria is no exemption
