Toyin Saraki Hails Supreme Court Judgement On GirlL-Child Inheritance In Igboland.




Mrs. Toyin Saraki, the Founder of Wellbeing Foundation Africa has applauded last Tuesday’s landmark judgement where the highest court in the land, the Supreme Court voided the long-held Igbo law and custom, which forbids a female from inheriting her late father’s estate.
Taking to her twitter account yesterday, Mrs. Saraki a well-known advocate for Maternal Child and Newborn Health as well as other women-related issues wrote “Goodnews for women and inheritance”



Mrs. Saraki has joined other women including Dr. Oby Ezekwisili who in the past few days have hailed the Supreme Court for stopping the discriminatory tradition against women and the girl-child.
It will be recalled that the Supreme Court while ruling on the appeal marked: SC.224/2004 filed by Mrs. Lois Chituru Ukeje  (wife of the late Lazarus Ogbonna Ukeje) and their son, Enyinnaya Lazarus Ukeje against Mrs. Cladys Ada Ukeje (the deceased’s daughter), made the landmark pronouncement on the grounds that it is discriminatory and conflicts with the provision of the constitution.



The court held that the practice conflicted with section 42(1)(a) and (2) of the 1999 Constitution. The judgment was on the appeal marked: SC.224/2004 filed by Mrs. Lois Chituru Ukeje  (wife of the late Lazarus Ogbonna Ukeje) and their son, Enyinnaya Lazarus Ukeje against Mrs. Cladys Ada Ukeje (the deceased’s daughter).
Cladys had sued the deceased’s wife and son before the Lagos High Court, claiming to be one of the deceased’s children and sought to be included among those to administer their deceased’s father’s estate.


The trial court found that he was a daughter to the deceased and that she was qualified to benefit from the estate of their father who died intestate in Lagos in1981.
The Court of Appeal, Lagos to which Mrs. Lois Ukeje and Enyinnaya Ukeje appealed, upheld the decision of the trail court, prompting them to appeal to the Supreme Court.
In its judgement last Friday, the Supreme Court held that the Court of Appeal, Lagos was right to have voided the Igbo’s Native Law and Custom that disinherit female children.
Justice Bode Rhodes-Vivour, who read the lead judgment, held that “no matter the circumstances of the birth of a female child, such a child is entitled to an inheritance from her later father’s estate.


“Consequently, the Igbo customary law, which disentitles a female child from partaking in the sharing of her deceased father’s estate is breach of Section 42(1) and (2) of the Constitution, a fundamental rights provision guaranteed to every Nigerian.
“The said discriminatory customary law is void as it conflicts with Section 42(1) and (2) of the Constitution. In the light of all that I have been saying, the appeal is dismissed. In the spirit of reconciliation, parties to bear their own costs,” Justice Rhodes-Vivour said.


Justices Walter Samuel Nkanu Onnoghen, Claral Bata Ogunbiyi, Kumai Bayang Aka’ahs and  John Inyang Okoro, who were part of the panel that heard the appeal, agreed with the lead judgement.culled from Nigerian monitor

Its not our fault that we were created specially and different and its only in our nature to stand out (lol). That being said, the issue of inheritance is based on the family in which one grew up. Some igbo parents share properties to all their children be it male or female, while some give it to only their males. The reason for the latter is bcos the father believes his daughter would get married and bear anoda man's name and identity. Personally, I dnt think this is a problem bcos if ur daughter gets married to a hardworking man, she won't have to scramble for properties with her brothers. Some igbo parents feel their duty to their female children is to educate and train them, after which they marry. As an igbo girl, my parents had a different mentality. They believed the female child deserved more dan the male. This was their believe and they tried their best to give us equal opportunities in terms of education and otherwise... Ppl shuld nt be quick to insult the igbo's at every little opportunity. This is our culture and we hold it dear to us. Other ethnic groups have some traditions dat seem strange too, dnt be soo quick to judge us.

  27. Stupid supreme court judgement! Are they that jobless these days?
    Who are the fools, lazy arse grown up idiots fighting over properties?? As in, they cannot work and build their fortune.
    Anyway, the judgement is for those that died inestate, and that is changing these days. You write your will as you like, make it tight to prevent all this lazy bones from getting their hands on anything. In fact, put a clause that says you get only N100 if you contest the will.

  29. This is a welcome development. ANON 4:32pm u are on point. Saint Ezewanyi, ur a fool to think that Anon 4; 32pm & her hubby has been depending on her father's wealth. All she is saying is that her father should also invest in her just as his investing on her bros after all they were conceived the same way & very human is equal b4 God & the law.Anon 11:36pm take note.
    Is it not painful & disheartened that a business she contributed in as a member of that family while is was still single is being shared to her brothers alone? The same brother's wife will end up showing off to her with her own father's money. A woman who never contributed to the business enjoys, while she fights to make ends meet in her husband's house.

  30. I get mad each time l see people fight so hard about religion and tribe. My question is, !Is it by your power or strenght that you are born an Igbo, hausa or yoruba?. Did God consult you or your parents before he fixed you in that family your are born?. Pls say no to tribalism. Say no to religious critics. We are all children of God. Am Igbo. Am not an addict of inheritance either from parents or husband. I ask God everyday to bless me beyond measure. I want to flow in wealth as a woman so that l will not depend on men rather men will depend on me. No looking back, forward ever till l become a billionaire.
