But until the court finds him guilty(I hope they do), benefit of the doubt must still be given to him. Still can't understand what will make a woman stay to take all these beatings for a long time.. DeleteA party to a marriage can file for divorce in d court once that marriage is conducted in a place of worship (church) recognised by d court. They need not have contracted it in d registry(court) before they can file for divorce. The church marriage certificate is also recognised by the court. This lawyer shld go n study his Marriage Act and Matrimonial Causes Act properly.

When a case is pending in court u shouldn't be discussing the details at length outside of court. All these she's posting will give Dino the edge to cook up his defence.

My boyfriend gave me the beating of my life because i complained that he talks to much n its quite embarrassing. Never in my wildest imagination have i ever thot that he could raise up his hands n beats me. He is a nice man n we were already making plans of getting married april2014. But d beating was an eye opener. He is begging but like they say that marriage is another ball game entirely n i refuse to be a victim of domestic violence.

The baptist church works hand in hand with the local government. The marriage certificate they issue is straight from the local government. So he's a big fool to assume that the certificate carries no weight.

ReplyDeleteThey were married in a licensed place of worship, which makes it a marriage per verba de praesenti that is...a declaration by the parties before witnesses.
I believe the above facts, places this marriage under the Act, hence Tokunbo has a right to seek dissolution of the marriage in a court.
I'm sorry, but is this some kind of defence to the cruelty and battery charges levelled against him by his wife?
I so hate divorce cases. Same reason I never take them.

ReplyDeleteFor every marriage to be valid, it must satisfy some laid down conditions in the law. one of which being that the marriage must be celebrated either in a recognized place of worship or in the marriage registry. any church does not have the right to contract any marriage in Nigeria. that is the reason why every valid marriage certificate must bear "the federal republic of Nigeria".
