Kenyan Women With HIV Sue Over Sterilisation


A group of HIV-positive women in Kenya has taken legal action against the government, accusing it of arranging for them to be forcibly sterilised.
The five women are demanding compensation from the government and the non-governmental organisations they say carried out the sterilisations.



Activists protested in the capital, Nairobi, to call for the practice to be banned, claiming it was widespread.
The government has not yet commented on their allegations.

One of the women, Teresia Otieno, told the BBC that she was sterilised without her consent.
"I went in for an operation to give birth to my first child. By the time I was leaving the operation the doctor told me I had been sterilised," Ms Otieno said.

The women are demanding financial compensation
The women marched from Nairobi's High Court to Uhuru Park with T-shirts bearing the words: "Enforced and coerced sterilization of women living with HIV".
Lawyer Allan Machele said the reproductive rights of the women had been breached, along with their right to dignity.
"When you sterilise women who are living with HIV, you have violated their rights," he added.

In 2012, a court in Namibia ruled that three HIV-positive women had been sterilised without their consent.

The case had been brought by three women who opted to have Caesarean deliveries to reduce the risk of passing the Aids virus to their babies.

OMG how in heavens name can you sterilise someone without their consent?This is just all shades of wrong!

  11. I know about sterilizing hospital equipments but Pls how do you sterilize a human being? Na question I ask bcos I no knw. And I feel stella no knw too... U just dey write OMG make e no be like say! Abeg how dem take dey stabilize person?

  16. Their living with HIV doesn't mean their rights shld be trampled on. They are still human beings and as such their consent shld be sought before decisions like dis shld be carried out. I seriously hope the govt has nothing to do with this.

  17. hmmm....how cn you sterilise a woman because she has HIV...hospitals are supposed to know better, worst part is they did it without their consent...imagine waking up after surgery, holding your baby and dreaming of having another one, only to be told you can't...#burnthathospitaltotheground...

  21. So wrong!!! Goes to show the level of awareness the government there has, even our local hospital know how to handle pregnant women Living with HIV to reduce/prevent Mother to child transmission, why sterilize them like animals? They should sue their asses and demand big money.

  24. For the benefit of those who do not know and for those pretending they know. Sterilization is a permanent procedure to prevent pregnancy. It is usually done by blocking the fallopian tubes.
    With this short explanation,I m sure you have better understanding of the story.

  26. So sad. They should sue the hell out of thier government. There is prevention of mothers to child transmission(PMTCT). Following the correct medical procedures they can hav HIV free children

  27. This story is funny and at the same time annoying... Sterilization wouldn't reducation the spread....because these women will still meet with men sexually.... Even if they are,married their husbands may need more children and sleep out side their matrimonial home just to achieve that and that action may even further increase the incidence of the virus.....remember the men won't go in to labour so they can't be sterilized... Psst
